3 AN ORDINANCE TO ABANDON A PORTION OF AN UNIMPROVED
4 TWENTY (20) -FOOT RIGHT -OF -WAY LOCATED SOUTH OF
5 BLOCK 3, HICK'S INTERURBAN ADDITION, MAINTAINING THE
6 EASEMENT RIGHTS FOR EXISTING UTILITY AND DRAINAGE
7 PURPOSES, IN THE CITY OF LITTLE ROCK, ARKANSAS; AND
8 FOR OTHER PURPOSES.

10 WHEREAS, a request was made to vacate and abandon a portion of an unimproved twenty
11 (20) -foot right -of -way, located South of Block 3, Hick's Interurban Addition, pursuant to the
12 City's general police power authority under Ark. Code Ann. § 14 -54 -104; and
13 WHEREAS, the Board has determined that the abandoning of this public right -of -way will
14 not have an adverse impact on the adjacent property owners nor public welfare and safety, and
15 therefore, the right -of -way abandoned by this ordinance is no longer needed for corporate
16 purposes, except as otherwise noted below;
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
18 THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby releases, vacates, and abandons a portion of an
20 unimproved twenty (20) -foot right -of -way, located South of Block 3, Hick's Interurban
21 Addition, said area of abandonment lying South of Lots 1 and 26, Hick's Interurban Addition
22 and extending 150 feet East of the existing right -of -way of Wilson Road, in the City of Little
23 Rock, Pulaski County, Arkansas.
24 Section 2. The City specifically reserves the existing easements for utilities and drainage.
25 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the
26 real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County,
27 Arkansas.
28 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
29 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
30 declaration or adjudication shall not affect the remaining portions of the ordinance which
31 remain in full force and effect as if the portion so declared or adjudged to be
32 unconstitutional were not originally a part of the ordinance. =� �` °•�A �o

I Section 5 . Repealer. All laws, ordinances, resolutions, or parts of the same that are
2 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
3 inconsistency.
