3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO
5 ENTER INTO A CONTRACT WITH SMITHS DETECTION, AS THE SOLE
6 SOURCE PROVIDER, FOR THE PURCHASE OF ONE (1) HAZARDOUS
7 MATERIALS GASNAPOR IDENTIFICATION TOOL, FOR USE BY THE
8 LITTLE ROCK FIRE DEPARTMENT HAZARDOUS MATERIAL TEAM, IN
9 THE AMOUNT OF SIXTY -SEVEN THOUSAND, FIVE HUNDRED DOLLARS
10 ($67,500.00) AND FOR OTHER PURPOSES.

12 WHEREAS, the Little Rock City Manager's Office/Emergency Management Division is committed
13 to improving hazardous material response and detection throughout the City; and
14 WHEREAS, in order to accomplish this goal, the Division proposes the purchase of one (1)
15 Hazardous Materials GasNapor Identification Tool to be utilized by the Little Rock Fire Department
16 Hazardous Material Team when there is a possibility of hazardous materials being present; and
17 WHEREAS, since this Hazardous Materials GasNapor Identification Tool functions as a part of the
18 equipment already in use by the Little Rock Fire Department Hazard Material Team, and Smiths
19 Detection is the sole source of this equipment, competitive bidding should be waived and the contract
20 awarded to Smiths Detection, in the amount of Sixty -Seven Thousand, Five Hundred Dollars
21 ($67,500.00);
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK, ARKANSAS:
24 Section 1. The Board of Directors finds that, for the reasons expressed above, competitive bidding
25 should be dispensed with in the purchase of the Hazardous Materials GasNapor Identification Tool to be
26 utilized by the Little Rock Fire Department Hazard Material Team.
27 Section 2. The City Manager is hereby authorized to dispense with competitive bidding and to enter
28 into a contract with Smiths Detection, for the purchase of one (1) Hazardous Materials GasNapor
29 Identification Tool, in the amount of Sixty -Seven Thousand, Five Hundred Dollars ($67,500.00);
30 Section 3. Funding for this purchase is provided through the State Homeland Security Grant
31 Program, with no fiscal impact upon the City of Little Rock.
32 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
33 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such

declaration or adjudication shall not affect the remaining portions of the ordinance which shall
remain in full force and effect as if the portion so declared or adjudged invalid or
unconstitutional were not originally a part of the ordinance.
Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with
any provision of this ordinance are hereby repealed to the extent of such conflict.
