HomeMy WebLinkAbout203891 ORDINANCE NO. 20,389 2 3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDS; TO AWARD A 4 THREE (3) -YEAR AGREEMENT FOR DSL SERVICES TO AT &T ARKANSAS, 5 IN THE AMOUNT OF NINETY -EIGHT THOUSAND, TWENTY -EIGHT DOL- E LARS ($98,028.00), PLUS APPLICABLE FEES AND TAXES; TO AUTHORIZE 7 ADDITIONAL ANNUAL EXTENSIONS OF THIS AGREEMENT AT THE DIS- 8 CRETION OF THE CITY MANAGER; TO DECLARE AN EMERGENCY; AND 9 FOR OTHER PURPOSES. 10 11 WHEREAS, to provide a trunk for DSL Service to the City's remote sites, AT &T Arkansas currently 12 bundles multiple T -1 lines utilizing Inverse Multiplexing (IMA) technology; and, 13 WHEREAS, this connection creates a private network that passes the security audits that are required 14 for the systems that run over these connections without requiring the City to purchase additional firewall 15 or Virtual Private Network equipment; and, 16 WHEREAS, because this cost - effective technology does not yet provide a single platform for vendor 17 interoperability, only AT &T Arkansas is able to provide this service over the City's existing equipment; 18 and, 19 WHEREAS, for an additional $14,532 per year, the City can increase the bandwidth speed from 3mb 20 to 6mb for these City facilities; and, 21 WHEREAS, the Little Rock Board of Directors recognizes the need to continue cost - effective DSL 22 Service with an increase in bandwidth speed for designated City facilities; 23 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK, ARKANSAS: 25 Section 1. The City Manager is authorized to enter into a three -year agreement with AT &T Arkan- 26 sas in the amount of Ninety -Eight Thousand, Twenty -Eight Dollars and no Cents ($98,028.00) plus appli- 27 cable fees and taxes, for 6mb DSL services for the Little Rock Police Department, Little Rock Fire De- 28 partment, Housing and Neighborhood Programs Department, Parks and Recreation Department, Fleet 29 Services, Little Rock Zoo and the Community Programs Department. 30 Section 2. Because of the critical need to continue secure DSL service without the purchase of ex- 31 pensive firewall or Virtual Private network equipment, the Board declares that it is impractical and unfea- 32 sible to submit this matter to a competitive bid process, and, therefore, waives competitive bidding. 33 Section 3. As long as the IMA technology does not provide a single platform for vendor interopera- 34 bility and AT &T Arkansas is the only provider of Remote Local Area Network DSL over an IMA circuit (PAGE 1 OF 21 ORDINANCE to waive competitive bids and to authorize an agreement with AT &T for DSL service I who can connect to all of the City's current locations, an annual resolution to add another year to the 2 agreement authorized by this Ordinance, and to establish the consideration for such a contract, is all the 3 legislative authority required, provided the City Manager certifies to the Board of Directors that there is 4 no other local provider of this service, and provided further than no such additional agreement will be for 5 more than a one (1) -year period of time. 6 Section 4. Funds for this service are appropriated as a line item in each department's operations 7 budget. 8 Section 5. Severability. In the event any portion of this ordinance is declared or adjudged to be inva- 9 lid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this or- 10 dinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or 11 unconstitutional was not originally a part of this ordinance. 12 Section 6. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any 13 provision of this ordinance are hereby repealed to the extent of such conflict. 14 Section 8. Emergency.
