That the zoning classification of the following described property be changed from R -2 to 13 PD -R: 14 Lot 27, Block 14, Midland Hills Addition to the City of Little Rock, Pulaski County, 15 Arkansas. Subject to and together with an easement for a joint private driveway upon the 16 south five (5) feet of the west 100 feet there of, and all interest in and to an easement for 17 a private driveway upon the north five (5) feet of the west 100 feet of Lot 26, Block 14, 18 Midland Hills Addition to the City of Little Rock, Pulaski County, Arkansas, AND Tract 19 2: Starting at the southwest corner of Lot 2, Block 14, Midland Hills Addition to the City 20 of Little Rock, Pulaski County, Arkansas, thence S76 °41'30 "W along the south line of 21 said Lot 2 extended for 20.02 feet; thence NO2 °47'08 "W for 23.10 feet to the point of 22 beginning; said point of being on the south line of Lot 27, Block 14, Midland Hills 23 Addition to the City of Little Rock, Pulaski County, Arkansas extended easterly for 24 3.93 feet; thence continue NO2 °47'08 "W for 60.03 feet to a point on the north line of said 25 Lot 27 extended east for 6.26 feet; thence East for 9.14 feet to the west face of a one 26 (1) -foot plus wide wall; thence S11 °32'38 "E along said west face of said wall for 24.80 27 feet; thence S 10 °48'47 "E along said west face of said wall for 26.04 feet; thence 28 S9 °17'09 "E along said west face of said wall for 0.09 feet to a point on the south line of 29 said Lot 27 extended easterly; thence S89 °59'36 "W and along the said south line of said 30 Lot 27 extended for 16.51 feet to the point of beginning. Now closed by Little Rock City Ordinance No. 14,041 of record as document No. 10 81- 19002, Records of Pulaski County, Arkansas. 11 Section 2. That the approval of Lombardi Short -Form PD -R (Z- 8612), located at 119 Crystal Court, 12 is subject to compliance with the following additional conditions: 13 That the preliminary site development plan /plat be approved as submitted, including 14 all staff comments and conditions as outlined in the Planning Commission Agenda Staff 15 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis 16 in paragraph H and subject to additional conditions imposed at the Planning Commission 17 Public Hearing as amended by the applicant. 18 Section 3. That the preliminary site development plan/plat be approved as recommended by the 19 Little Rock Planning Commission. 20 Section 4. That the change in zoning classification contemplated for Lombardi Short-Form PD -R 21 (Z- 8612), located at 119 Crystal Court, is conditioned upon obtaining a final plan approval within the 22 time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. 23 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little 24 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects 25 necessary to affect and designate the change provided for in Section 1 hereof. 26 Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the 27 plan. 28 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 29 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 30 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 32 ordinance. 33 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent 34 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
