3 AN ORDINANCE TO APPROVE A PLANNED ZONING DEVELOPMENT AND
4 ESTABLISH A PLANNED COMMERCIAL DISTRICT TITLED CHENAL
5 PARKWAY DEVELOPMENT, LLC, REVISED LONG -FORM PCD (Z- 4933 -H),
6 LOCATED AT 15707 CHENAL PARKWAY, LITTLE ROCK, ARKANSAS,
7 AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK,
8 ARKANSAS; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES.

10 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
11 THE CITY OF LITTLE ROCK, ARKANSAS:
12 Section 1. That the zoning classification of the following described property be changed from PCD
13 to Revised PCD:
14 Lot 1 One Source Addition to the City of Little Rock, Pulaski County, Arkansas as
15 shown on plat recorded as Plat Book D, Page 730, records of Pulaski County, Arkansas,
16 AND Part of the N '/z NW '/4 of Section 6, T -1 -N, R -13 -W, Little Rock, Pulaski County,
17 Arkansas, more particularly described as: Beginning at the NE corner of Lot 1, One
18 Source Addition, an Addition to the City of Little Rock, Pulaski County, Arkansas, said
19 corner lying on the south right -of -way line of Chenal Parkway; thence S59 °55'48 "E
20 along said right -of -way line, 178.99 feet to a point on the west right -of -way line of a
21 future street; thence S19 °45'12 "W along said west right -of -way line, 250.01 feet to the
22 easternmost corner of said Lot 1, One Source Addition; thence N65 °14'49 "W along
23 the northerly line of said Lot 1, 200.0 feet; thence N24 °45' 12 "E along the easterly line
24 of said Lot 1, 265.65 feet to the point of beginning.
25 Section 2. That the approval of Chenal Parkway Development LLC Revised Long -Form PCD (Z-
26 4933 -H), located at 15707 Chenal Parkway, is subject to compliance with the following additional
27 conditions:
28 That the preliminary site development plan /plat be approved as submitted, including
29 all staff comments and conditions as outlined in the Planning Commission Agenda Staff

Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
in paragraph H and subject to additional conditions imposed at the Planning Commission
Public Hearing as amended by the applicant. ,.�`'��j►�

I Section 4. That the change in zoning classification contemplated for Chenal Parkway Development
2 LLC Revised Long -Form PCD (Z- 4933 -H), located at 15707 Chenal Parkway, is conditioned upon
3 obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of
4 the Code of Ordinances.
5 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
6 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
7 necessary to affect and designate the change provided for in Section 1 hereof.
8 Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the
9 plan.
10 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
11 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
12 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
13 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
14 ordinance.
15 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
16 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
17 Section 9. Emergency Clause. This particular rezoning request to a revised PCD is required to
18 assure that the development of this property is more conducive with surrounding properties and uses
19 within the area; and emergency is, therefore, declared to exist and this ordinance shall be in full force
20 and effect from and after the date of its passage and the final approval of the plan as set forth in Section
21 8.
