3 AN ORDINANCE TO ABANDON A PORTION OF A UTILITY AND DRAINAGE
4 EASEMENT RETAINED IN THE FORMERLY ABANDONED RIGHT -OF -WAY
5 OF NORTH CEDAR STREET LOCATED, SOUTH OF OAKWOOD ROAD, IN
6 THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

8 WHEREAS, a request was made to vacate and abandon a utility and drainage easement in the
9 formerly abandoned right -of -way of North Cedar Street, located south of Oakwood Road, in the City of
10 Little Rock, Arkansas, pursuant to the City's general police power authority under Ark. Code Ann. § 14-
11 54 -104; and
12 WHEREAS, the Board has determined that the abandoning of this utility and drainage easement will
13 not have an adverse impact on the adjacent property owners nor the local traffic, and therefore, the
14 easement abandoned by this ordinance is no longer needed for corporate purposes;
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK, ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons the portion of the
18 easement retained in the formerly abandoned right -of -way of North Cedar Street, located south of
19 Oakwood Road, Little Rock, Arkansas, more particularly described as:
20 Part of the west one -half of the former right -of -way of North Cedar Street lying south of
21 Oakwood Road, City of Little Rock, Pulaski County, Arkansas, more particularly
22 described as follows: Commencing at the southeast corner of Lot 6, Yorkshire Place;
23 thence north along the west right of way line of said former North Cedar Street, 44.5 feet
24 to the point of beginning; thence continuing north, 29.4 feet; thence east six (6) feet;
25 thence south 29.4 feet; thence west six (6) feet to the point of beginning containing 176.4
26 square feet, more or less.
27 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
28 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
32 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally apart
33 of the ordinance.
