ORDINANCE NO. 20,329
AN ORDINA CE TO APPROVE THE CONTRACT WITH SAGE V;
AUTHORIZE THE CITY MANAGER TO EXECUTE THE CON-
TRACT; TO DECLARE AN EMERGENCY; AND, FOR OTHER PUR-
POSES.

WHEREAS, the autho
ity to operate and maintain the Little Rock Wastewater Utility is vested in the
9
Little Rock Sanitary Sewer
Committee ( "the Committee "), but the authority to establish an equitable rate
10
system is vested in the City
Board of Directors ( "the Board "); and,
11
WHEREAS, the City
f Little Rock amended Little Rock, Ark., Rev. Code § 35 -152 to allow the
12
Committee to recommended
to the Board contracts for a facility that provides its own conveyance direct -
13
ing its waste stream to the digester
or another specialty treatment process which does not commingle with
14
the influent at the headwor
s of the Wastewater Treatment Plant, and which does not adversely impact
15
the fair and reasonable rate
structure applicable to all customers; and,
16
WHEREAS, Sage V Foods,
LLC, desires to construct a force main line to transfer process wastewa-
17
ter discharge from its plant
to the Little Rock Wastewater Treatment Facility at the anaerobic digester
18
resulting in less demand on
the overall Sewer system since this waste will not be commingled with other
19
sewerage at the Treatment F
lant prior to it entering the digester treatment process; and
20
WHEREAS, the Committee
recommends that the Board approve the attached contract and authorize
21
the City Manager to execuW
it as it meets the requirements set fort in the Revised Code and it is in the
22
best interests of the City and
the Committee's customers to permit such this contract since these excep-
23
tional circumstances exist.

NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF

THE CITY OF LITTL
ROCK, ARKANSAS:

Section 1. The attache contract with Sage V recommended by the Sewer Committee is hereby ap-
proved by the City Board of Directors since this facility will provide its own conveyance directing its
waste stream to the digeste or another specialty treatment process which does not commingle with the
influent at the headworks o the Wastewater Treatment Plant, and the approval of this contract does not
adversely impact the fair and reasonable rate structure applicable to all customers.
Section 2. The City M pager is hereby authorized to execute this contract.

* In the event any section, subsection, subdivision, paragraph, sub -
clause, phrase, or word of this ordinance is declared or adjudged to be

invalid or unconstitutional, such declaration or adjudication shall not affect the remaining provi-
sions of this ordinance, as if such invalid or unconstitutional provision was not originally a part
of this ordinance.
Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
ordinance are hereby repeal d to the extent of such inconsistency.
Section 5. Emergency Clause. It is essential to the operation of the Little Rock Wastewater Util-
ity to ensure that appropriate income is available to it for operations; it is also essential that the rate
structure charged for all cu tourers be fair and reasonableā but which may, in exceptional circumstances,
justify a contractual rate fr such services; such assurances are necessary to protect the public health,
safety and welfare; an eme gency is, therefore, declared to exist and this ordinance shall be in full force
and effectfrom and after th date of its passage.
