That the zoning classification of the following described property be changed from PD -C 13 to Revised PD -C: 14 Part of the SE 'A of Section 36, T -2 -N, R -14 -W, Little Rock, Pulaski County, Arkansas, 15 more particularly: described as follows: Beginning at a point twenty -five (25) feet (deed) 16 west and 540 feat (deed) north of the southeast corner of the SW '/4 SE '/4, said Section 17 36: Thence N87- 28'43 "W, 89.32 feet; thence SO1 °13'56 "W, 29.83 feet; thence 18 N87 °32'06 "W, 120.40 feet; thence N87 °32'58 "W, 339.73 feet; thence N87 °04'18 "W, 19 50.30 feet; thence N01°26'49 "E, 154.50 feet; thence S87 °37'29 "E, 390.22 feet; thence 20 S87 021'21 "E, 209.82 feet; thence SOl °38'04 "W, 125.03 feet to the point of beginning, 21 containing 2.0747 acres more or less. 22 AND 23 Part of the SW i/4 SE '/4 of Section 36, T -2 -N, R -14 -W, Little Rock, Pulaski County, 24 Arkansas more particularly described as follows: Commencing at the intersection of the 25 west right -of -way line of Kirk Road (50' R/W) and the north line of the fifty (50) -foot 26 wide raw water line easement; thence NOI'23'30 "E along said west right - of-way line, 27 281.48 feet to a'found Yz -inch rebar and the point of beginning; thence NOI'02'33 "E 28 continuing along'isaid west right -of -way line, 190.79 feet to a found Y2 -inch pipe; thence 29 N87 °21'20 "W, 89.61 feet to a found iron pin; thence S00 °41' 16 "W, 29.99 feet to a found 30 % -inch rebar; thence S88 °15'47 "E, 89.60 feet to the point of beginning, containing 31 17,138 square feet or 0.3934 acres more or less. 32 Section 2. That the approval of Parkway Automotive Revised Short-Farm PD -C (Z-7897- AX,,lo0aw,¢ 33 at 708 Kirk Road, is subject to compliance with the following additional conditions: ,� � .0 I 4CUip''s; v `° • •'tee O �n [Page 1 of 21 I That the preliminary site development plan/plat be approved as submitted, including all 2 staff comments and conditions as outlined in the Planning Commission Agenda Staff 3 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis 4 in paragraph H and subject to additional conditions imposed at the Planning Commission 5 Public Hearing as amended by the applicant. 6 Section 3. That the preliminary site development plan /plat be approved as recommended by the 7 Little Rock Planning Commission. 8 Section 4. That the change in zoning classification contemplated for Parkway Automotive Revised 9 Short-Form PD -C (Z- 7897 -A), located at 708 Kirk Road, is conditioned upon obtaining a final plan 10 approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of 11 Ordinances. 12 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little 13 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects 14 necessary to affect and designate the change provided for in Section 1 hereof. 15 Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the 16 plan. 17 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 18 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 19 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 20 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 21 ordinance. 22 Section 8. Repealer.
