3 AN ORDINANCE TO APPROVE A PLANNED ZONING DEVELOPMENT AND
4 ESTABLISH A PLANNED COMMERCIAL DISTRICT TITLED HERITAGE
5 COLLEGE SHORT -FORM PCD (Z- 8560), LOCATED EAST OF HERITAGE
6 COLLEGE, ACCESSED VIA A TWENTY -FIVE (25) -FOOT ACCESS
7 EASEMENT FROM RODNEY PARHAM ROAD, LITTLE ROCK, ARKANSAS,
8 AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK,
9 ARKANSAS; AND FOR OTHER PURPOSES.

11 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
12 OF LITTLE ROCK, ARKANSAS:
13 Section 1. That the zoning classification of the following described property be changed from MF-
14 24 to PCD:
15 A tract of land located in the SE '/4, Section 34, T -2 -N, R -13 -W, in the City of Little
16 Rock, Pulaski County, Arkansas, more particularly described as follows: Starting at the
17 northernmost corner of Lot 8, Paragon Place Addition to the City of Little Rock,
18 Arkansas; thence N51 °24'33 "E, 135.46 feet; thence S33 052'25 "E, 45.36 feet to the
19 point of beginning of the tract of land herein described: thence N44 °53'57 "W, 5.33 feet;
20 thence S51 °28'43 "W, 116.47 feet; thence S15 °13'41 "W, 23.80 feet to a point on the
21 north line of said Lot 8; thence S33 °53'55 "E along said north line, 237.78; thence
22 N56 007'35 "E, 135.0 feet; thence N33 °52'25 "W, 257.78 feet to the point of beginning
23 containing 0.7957 acre more or less.
24 Section 2. That the approval of Heritage College Short-Form PCD (Z- 8560), located East of Heritage
25 College, accessed via a 25 -foot access easement from Rodney Parham Road is subject to compliance with
26 the following additional conditions:
27 That the preliminary site development plan/plat be approved as submitted, including all
28 staff comments and conditions as outlined in the Planning Commission Agenda Staff
29 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
30 in paragraph H and subject to additional conditions imposed at the Planning Commission
31 Public Hearing as amended by the applicant.
32 Section 3. That the preliminary site development plan/plat be approved as recommended by the
33 Little Rock Planning Commission.

I Section 4. That the change in zoning classification contemplated for Heritage College Short-Form
2 PCD (Z- 8560), located East of Heritage College, accessed via a twenty -five (25) -foot access easement
3 from Rodney Parham Road is conditioned upon obtaining a final plan approval within the time specified
4 by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances.
5 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
6 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
7 necessary to affect and designate the change provided for in Section 1 hereof.
8 Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the
9 plan.
10 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
11 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
12 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
13 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
14 ordinance.
15 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
16 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
