3 AN' ORDINANCE TO APPROVE A PLANNED ZONING DEVELOPMENT AND
4 ESTABLISHING A PLANNED RESIDENTIAL DISTRICT TITLED ROWAN
5 PARK AT KANIS LONG -FORM PD -R (Z- 7665 -B), LOCATED ON THE WEST
6 SIDE OF KIRBY ROAD, APPROXIMATELY 400 FEET NORTH OF THE
7 KANIS ROAD AND KIRBY ROAD INTERSECTION, LITTLE ROCK,
8 ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF
9 LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

11 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
12 OF LITTLE ROCK, ARKANSAS.
13 Section 1. That the zoning classification of the following described property be changed from PD -R
14 to Revised PD -R:
15 Part of Tract 13, Sachs' Suburban Tracts, Pulaski County, Arkansas, being shown on plat
16 recorded in Book 2, Page 87, more particularly described as follows: Beginning at the
17 Northeast corner of said Tract 13; thence S01 °40'02 "W along the east line of said Tract
18 13, a distance of 900.88 feet; thence N87 °39'30 "W, a distance of 308.97 feet to the west
19 line of said Tract 13; thence N00 °19'09 "E along the west line of said Tract 13, a distance
20 of 900.51 feet to the northwest corner of said Tract 13; thence S87 °48'29 "E along the
21 north line of said Tract 13, a distance of 330.15 feet to the point of beginning containing
22 6.61 acre more or less.
23 Section 2. That the approval of Rowan Park at Kanis Long -Form PD -R (Z- 7665 -B), located on the
24 West side of Kirby Road approximately 400 feet North of the Kanis Road and Kirby Road intersection is
25 subject to compliance with the following additional conditions:
26 That the preliminary site development plan /plat be approved as submitted, including all
27 staff comments and conditions as outlined in the Planning Commission Agenda Staff
28 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
29 in paragraph H and subject to additional conditions imposed at the Planning Commission
30 Public Hearing as amended by the applicant.
31 Section 3. That the preliminary site development plan/plat be approved as recommended by the
32 Little Rock Planning Commission.
33 Section 4. That the change in zoning classification contemplated for Rowan Park at Kanis Long -
34 Form PD -R (Z- 7665 -B), located on the West side of Kirby Road approximately 400 feet North of the

I Kanis Road and Kirby Road intersection is conditioned upon obtaining a final plan approval within the
2 time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances.
3 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
4 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
5 necessary to affect and designate the change provided for in Section 1 hereof.
6 Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the
7 plan.
8 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
9 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
10 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
11 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
12 ordinance.
13 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
14 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
