3 AN ORDINANCE TO ABANDON THE SIXTY (60) -FOOT WIDE WEST
4 17TH STREET RIGHT -OF -WAY, LOCATED IMMEDIATELY EAST
5 OF MARSHALL STREET AND RUNNING FOR ONE AND ONE -HALF
6 (11/2) BLOCKS, IN THE CITY OF LITTLE ROCK, ARKANSAS; AND
7 FOR OTHER PURPOSES.
8 WHEREAS, a request was made to vacate and abandon the sixty (60)- foot -wide West 171h Street
9 right -of -way, located immediately East of Marshall Street and running for one and one -half (1' /2) blocks,
10 in the City of Little Rock, Arkansas, pursuant to the City's general police power authority under Ark.
11 Code Ann. § 14 -54 -104; and
12 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have
13 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the street rights -of-
14 way abandoned by this ordinance are no longer needed for corporate purposes, except as otherwise noted
15 below;
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons the sixty (60) -foot wide
19 West 17th Street right -of -way, located immediately East of Marshall Street and running for one and one -
20 half (11/2) blocks, in the City of Little Rock, Arkansas.
21 Section 2. The City specifically reserves the public utility and drainage easements.
22 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
23 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
24 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
25 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
26 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
27 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
28 of the ordinance.
29 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
30 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
