3 AN ORDINANCE TO ABANDON PORTIONS OF TAYLOR STREET,
4 FILLMORE STREET, WEST 311T STREET AND ALLEYS LOCATED
5 WITHIN AND ADJACENT TO BLOCKS 8 AND 15, C.O. BRACK
6 ADDITION (BETWEEN WEST 30TH STREET AND WEST 32ND
7 STREET); AND FOR OTHER PURPOSES.
8 WHEREAS, a request was made to vacate and abandon portions of Taylor Street, Fillmore
9 Street, West 31St Street and alleys located within and adjacent to Blocks 8 and 15, C.O. Brack
10 Addition (between West 30th Street and West 32nd Street), pursuant to the City's general police
11 power authority under Ark. Code Ann. § 14 -54 -104; and
12 WHEREAS, the Board has determined that the abandoning of this public right -of -way will
13 not have an adverse impact on the adjacent property owners nor the local traffic, and therefore,
14 the easements abandoned by this ordinance are no longer needed for corporate purposes, except
15 as otherwise noted below;
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
17 THE CITY OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons the following
19 described right -of -way:
20 a. Taylor Street (forty (40) -foot wide right -of -way) between West 30th Street and
21 West 32nd Street (approximately 583 feet);

23 b. West 31St Street (forty (40) -foot wide right -of -way) running approximately
24 133 feet from the Taylor Street right -of -way, between Blocks 8 and 15, C.O.
25 Brack Addition;

27 c. Fillmore Street (twenty (20) -foot wide right -of -way) running approximately
28 275 feet North from the West 32nd Street right -of -way and approximately 199
29 feet South from the West 30th Street right -of -way, adjacent to Blocks 8 and
30 15, C.O. Brack Addition;

32 d. Alley (ten (10) -foot wide right -of -way) running North/South within Block 8,
33 C.O. Brack Addition (approximately 299 feet);

35 e. Allen (ten (10) -foot wide right -of -way) running North/South within Block 15,
36 C.O. Brack Addition (approximately 245 feet);

38 Section 2: Easement rights are to be retained in the Taylor Street right -of -way abandonment.

I Section 3: The portions of West 31st Street, Fillmore Street and alleys are to be fully
2 abandoned with no remaining easement rights, subject to the following condition:
3 The easement abandonment will not become effective until existing utilities are
4 removed or relocated and new easements are dedicated for relocations.

6 Section 4. The City specifically reserves the public utility and drainage easements.
7 Section 5. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the
8 real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County,
9 Arkansas.
10 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause,
11 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
12 declaration or adjudication shall not affect the remaining portions of the ordinance which shall
13 remain in full force and effect as if the portion so declared or adjudged to be invalid or
14 unconstitutional were not originally a part of the ordinance.
15 Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are
16 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
17 inconsistency.
