8 WHEREAS, u Petition to form City of Little Rock Municipal Property Owners' Multipurpose
9 Improvement District No. 20l0-]|| (The Gardens u1Valley Falls Recreation Project) haaheeofi\edr/khLhe
|O Little Rock City Clerk; and
I WHEREAS, the City Clerk has presented the petition to the Mayor; and
12 WHEREAS, the Mayor has set April 6, 20 10, ut6:00 p.m. as the date and time for a hearing before the
13 Little Rock Board of Directors for consideration of the petition; and
14 WHEREAS, the Little Rock Board of Directors has determined from an abstractor's certificate of property
15 ownership that those signing the petition constitute all the owners of the real property to be located in said
16 district; and
17 WHEREAS, the Arkansas Municipal Property Owners' Improvement District Law provides that if the
18 governing body determines that all the owners ofthe real property tobe located in the district have petitioned
14 for the improvements, it shall then be its duty by ordinance to establish and lay off the district as defined in the
70 petition and to appoint the commissioners named in the petition.
21 NOW, THEREFORE, BEITORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
22 LITTLE ROCK, ARKANSAS:
23 8eodoo 1. That the real property dceodbod in Exhibit "A" attached hereto and made a part hereof is
24 hereby established and laid off as City of Little Rock Municipal Property Owners'Multipurpose lmprovcmen1
25 District No. 2010-311 (The Gardens at Valley Falls Recreation Project) for the purpose of constructing, either
20 within or without the boundaries of the District, if the property within the District will bchenefiicd thereby, the
27 cost of construction of various improvements for recreational purposes, and all construction associated with the
78 installation of the above.
29 Section 2. The following three individuals are hereby appointed ua commissioners of said improvement
30 district: Boyce Holmes, Pat Moknsbonn and Brandon Huffman.
3l Section 3. The name of improvement district shall be City of Little Rock Municipal Property Owners'
32 Multipurpose Improvement District No. 20l0'3ll (The Gardens ut Valley Falls Recreation Project)

Section 4. The Board of Directors hereby determines that there is a need for additional infrastructure
within the City and hereby determines that the passage of this ordinance will facilitate construction of
additional infrastructure within the City. Therefore, an emergency is hereby declared to exist, and this
ordinance being necessary for the public health, safety and welfare shall be in full force and effect from and
after its passage and approval.
