4 MUNICIPAL PROPERTY OWNERS' MULTIPURPOSE IMPROVEMENT

8 WHEREAS, u Petition to fbnn City of Little Rock Municipal Property Owners' Multipurpose
q Improvement District No. 2010-3 10 (The Gardens at Valley Falls) has been filed with the Little Rock City
10 Clerk; and
I WHEREAS, the City Clerk has presented the petition to the Mayor; and
17 WHEREAS, the Mayor has set April 6,2OlO,uth:UUp.nn. uu the date and time for u hearing before the
13 Little Rock Board ofDirectors for consideration uf the petition; and
14 WHEREAS, the Little Rock Board of Directors has determined from an abstractor's certificate of property
15 ownership that those signing the petition constitute all the owners of the real property 10 be located in said
16 district; and
17 WHEREAS, the Arkansas Municipal Property Owners' Improvement District Luvvprovidcmtho1iftbo
18 governing body determines that all the owners of the real property to be located in the district have petitioned
lq for the improvements, it shall then be its duty by ordinance to establish and lay off the district as defined in the
20 petition and to appoint the oononuieuionom named in the petition.
21 NOW, THEREFORE, BEITORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
22 LITTLE ROCK, ARKANSAS:
23 Seubaa 1. That the real property described in Exhibit "/\" attached hereto and zuudo u part hereof is
24 hereby established and laid off as City of Little Rock Municipal Property Owners'Multipurpose Improvement
25 District No. 20l0'3|0 (The Gardens a1 Valley Falls) for the purpose ofconstructing, either within or without
26 the boundaries of the District, if the property within the District will bebcncfited thereby, a sewage collection
77 system, water distribution system, telephone service system, cable television service system, e|odzioul
78 distribution system, natural gas distribution oyutoru, u system ofroads and dzcotm, including sidewalks, curbs
29 and gutters, underground drainage ayytenu` unyutenn of street lighting, retaining walls, and landscaping, and all
30 b�nchin9` excavating, grading and all construction associated with the installation o[ the above systems,
31 together with facilities related to any of the foregoing within said district.
32 Section 2. The following three individuals are hereby appointed as commissioners of said iigpv,,qjnent

33 district: Boyce Holmes, Pat Malmstrom and Brandon Huffman.

Section 3. The name of improvement district shall be City of Little Rock Municipal Property Owners'
Multipurpose Improvement District No. 2010 -310 (The Gardens at Valley Falls).
Section 4. The Board of Directors hereby determines that there is a need for additional infrastructure
within the City and hereby determines that the passage of this ordinance will facilitate construction of
additional infrastructure within the City. Therefore, an emergency is hereby declared to exist, and this
ordinance being necessary for the public health, safety and welfare shall be in full force and effect from and
after its passage and approval.
