3 AN ORDINANCE TO ABANDON CERTAIN UTILITY EASEMENTS
4 WITHIN THE FORMER UNIVERSITY MALL SITE WHICH WERE
5 GRANTED TO ARKANSAS POWER & LIGHT (ENTERGY
6 CORPORATION); AND FOR OTHER PURPOSES.

8 WHEREAS, a request was made to vacate and abandon certain utility easements within the former
9 University Mall site, located at 300 South University Avenue, which were granted specifically to
10 Arkansas Power & Light (Entergy Corporation),pursuant to the City's general police power authority
11 under Ark. Code Ann. § 14 -54 -104; and
12 WHEREAS, the Board has determined that the easements to be abandoned lie entirely within the
13 applicant's property and any new easements will be obtained as needed; and, therefore, the easements
14 abandoned by this ordinance are no longer needed for corporate purposes;
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK, ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons the easements specifically
18 described as follows:
19 Easement 91
20 Beginning at a point 608.9 ft. North and 30 feet East of the SW corner of SEI /4 NEI /4, Section
21 1, Township 1 North, Range 13 West; thence North 5706' East 216.9 ft.; thence South
22 88 °29' east 568.5 ft.; thence North 58 °45' East 51.8 ft.; thence South 01 °20' West 7.4 ft.;
23 thence South 4703' East 59.1 ft.

25 Beginning at a point 325 ft. North and 30 feet East of the SW corner of the SEI /4 NEI /4,

Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
of the ordinance.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
