HomeMy WebLinkAbout202222010009380 Received: 292212010 8 :56:06 AM Recorded: 0212292010 09:13°63 AM Filed Recorded in official Records of PAT °BRIEF.;.. 1 ORDINANCE NO. 20.,222 PULASKI COUNTY CIRCUITICO UNTY CLERK 2 Fees $20.00 3 AN ORDINANCE TO ABANDON A PORTION OF A TWENTY-FIVE - 4 FOOT WIDE ACCESS AND UTILITY EASEMENT LOCATED 5 6 7 ALONG THE SOUTH PERIMETER OF LOT 1, CHENONCEAU COMMERCIAL SUBDIVISION, IN THE CITY OF LITTLE ROB; ARKANSAS AS PUBLIC RIGHT -OF -WAY; AND FOR Oar 8 PURPOSES. 10 WHEREAS, a request was made to vacate and abandon a portion of a twenty- 11 access and utility easement located along the south perimeter of Lot 1, Chenonceau Commercial 12 Subdivision, located at the southeast corner of Chenonceau Boulevard and Cantrell Road, 13 pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54 -104; and 14 WHEREAS, the Board has determined that the abandoning of this public right -of -way will 15 not have an adverse impact on the adjacent property owners nor the local traffic, and therefore, 16 the right -of -way abandoned by this ordinance is no longer needed for corporate purposes; 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 18 THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. The Board of Directors hereby releases, vacates, and abandons a portion of a 20 twenty -five -foot wide access and utility easement located along the south perimeter of Lot 1, 21 Chenonceau Commercial Subdivision, located at the southeast corner of Chenonceau Boulevard 22 and Cantrell Road, as public right -of -way. 23 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the 24 real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, 25 Arkansas. 26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, 27 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 28 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 29 remain in full force and effect as if the portion so declared or adjudged to be invalid or 30 unconstitutional were not originally a part of the ordinance. 31 Section 4. Repealer.
