CODE § 7 -127 (10&) T' `61ANGE THE METHOD AND AMOUNT FOR FEES CHARGED TO OFF - AIRPORT PARKING FACILITIES; AND FOR OTHER PURPOSES. 7 WHEREAS, the City of Little Rock, Arkansas, has the authority by state law and local ordinance to 8 establish parking fees for businesses that serve the Little Rock National Airport (:the Airport"); and, 9 WHEREAS, these fees have not been increased since at least 1992, although there have been con - 10 tinuous additional demands upon the Airport to comply with federal regulations, particularly federal secu- 11 rity regulations imposed since September 11, 2001, by the federal government; and, 12 WHEREAS, one of the few ways the Airport can capture revenues to aid in the payment of these 13 costs is to charge for parking on airport properties, and pursuant to law to charge fees to off - airport busi- 14 nesses that provide parking facilities for persons who use airport properties; and, 15 WHEREAS, the Little Rock Airport Commission ( "the Commission ") has requested an increase in 16 the fees that are charged by off - airport businesses that operate parking facilities; and, 17 WHEREAS, the Commission has periodically increased the fees to be charged to park on airport 18 properties; 19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 20 OF LITTLE ROCK, ARKANSAS: 21 Section 1. Upon the passage and publication of this ordinance, Little Rock, Ark., Rev. Code § 7 -127 22 (c) (1 988) is hereby amended to read as follows: 23 Class C. Each Class C business shall pay a fee based upon the following calculation: 24 Six and one -half percent (6.5 %) of the receipts for occupied parking spaces. A space 25 is "occupied" if the parking space generates any income for the Class C business for 26 that day. The monthly fee shall be transmitted with a copy of 4 the contemporaneous monthly sales tax report submitted by the business to the Arkan- 5 sas Department of Finance and Administration. 6 Section 2. Effective January 1, 2012, Little Rock, Ark., Rev. Code § 7 -127 (c) (1988), as amended, 7 is hereby amended to read as follows: 8 Class C. Each Class C business shall pay a fee based upon the following calculation: 9 Seven and one -half percent (7.5 %) of the receipts for occupied parking spaces. Severability. In the event any section, subsection, subdivision, paragraph, 4 subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged 5 to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining 6 provisions of this ordinance, as if such invalid or unconstitutional provision was not originally a 7 part of this ordinance. 8 Section 5. Repealer.
