6 (Z- 8445 -A), LOCATED AT 5910 C STREET, LITTLE ROCK, ARKANSAS,
7 AMENDING ORDINANCE NO. 20,114 AND THE OFFICIAL ZONING
8 MAP OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
9 PURPOSES.

11 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
12 OF LITTLE ROCK, ARKANSAS:
13 Section 1. That Ordinance No. 20,114 adopted by the Little Rock Board of Directors on August 3,
14 2009, be amended to provide for a modification of the Planned Zoning Development described as C
15 Street Surgery Center Revised Short-form POD (Z- 8445 -A), located at 5910 C Street.
16 Section 2. That the zoning classification of the following described property be changed from POD
17 to Revised POD:

19 Tract 3 - Part of Lot 16, Howard Adams and R.D. Plunkett's Subdivision,
20 Little Rock, Pulaski County, Arkansas, more particularly described as
21 beginning 25.0 feet north and 313.0 feet east of the southwest corner of said
22 Lot 16; thence north, 195.0 feet; thence east 51.0 feet; thence south, 195.2
23 feet; thence west 51.0 feet to the point of beginning.

25 Section 3. That the approval of C Street Surgery Center Revised Short-form POD (Z- 8445 -A),
26 located at 5910 C Street is subject to compliance with the following additional conditions:

28 • That the preliminary site development plan /plat be approved as
29 submitted, including all staff comments and conditions as outlined in the
30 Planning Commission Agenda Staff Report in paragraphs D, E, F and
31 including any conditions indicated in the staff analysis in paragraph H
32 and subject to additional conditions imposed at the Planning
33 Commission Public Hearing as amended by the applicant.

• The outfall for the adjacent parking lot is to be reconstructed with the
current application request.
Section 4. That the preliminary site development plan/plat be approved as recommended by the
Little Rock Planning Commission.
Section 5. That the change in zoning classification contemplated for C Street Surgery Center
Revised Short-form POD (Z- 8445 -A), located at 5910 C Street is conditioned upon obtaining a final plan
approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of
Ordinances.
Section 6. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
necessary to affect and designate the change provided for in Section 2 hereof.
Section 7. That this Ordinance shall not take effect and be in full force until the final approval of the
plan.
Section 8. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.
Section 9. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
