5 REFERENCE OF THE 2009 INTERNATIONAL PROPERTY
6 MAINTENANCE CODE AND 2009 REVISIONS; AND FOR OTHER

9 WHEREAS, Little Rock, Ark. Rev. Code 8 -2 (3) adopts by reference the 2009 Edition of the
10 International Property Maintenance Code with 2009 Revisions published by the International
11 Code Council, Falls Church, Virginia; and
12 WHEREAS, the City has complied with Ark. Code Ann. X 14 -55 -207 (1987) by publishing a
13 notice of intent to adopt these technical codes by reference in a paper of general circulation
14 within the municipality and three copies of codes have been available for inspection in the City
15 Cleric's office by the public prior to their adoption; and
16 WHEREAS, the City will accept and enforce the AR State Amendments and Revisions to the
17 2009 International Property Maintenance Code if officially adopted by the State; and
18 WHEREAS, this Ordinance amendment is necessary to update the City Code and authorize
19 the use of the 2009 Edition within the City.
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
21 THE CITY OF LITTLE ROCK, ARKANSAS.
22 Section 1. Section 8 -2 (3) of Little Rock, Arkansas Revised Code is hereby amended to read
23 as follows:
24 Section 8 -2 Codes Adopted.
25 (A) The following publications are adopted by reference:
26 (3) The 2009 International Property Maintenance Code with 2009
27 Revisions and deletes Section 303.2.in its entirety.
28 (B) Notwithstanding the provisions of Sections (A) above, the City, consistent
29 with other provisions of state law, shall set the job qualification for its
30 employees. No job qualifications contained in the International Property
31 Maintenance Code are adopted in any form whatsoever.

Section 2. All ordinances or parts of Ordinances in conflict with this provision are hereby
repealed to the extent of the conflict.
Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
declaration or adjudication shall not affect the remaining portions of the ordinance which shall
remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional
was not originally a part of the ordinance.
Section 4. Code Application. Permits obtained prior to the effective date of this ordinance
will be enforced under the previous adopted code till final disposition of the permit.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
inconsistency.
Section 6. Effective date of this ordinance shall be January 1, 2010.
