ORDINANCE NO. 3 20,078 (DECEMBER 22, 2008), TO ADJUST THE FISCAL YEAR 2009 4 BUDGET ORDINANCE TO REFLECT REVENUE AND EXPENDITURE 5 ADJUSTMENTS FOR THE GENERAL FUND; TO DECLARE AN 6 EMERGENCY; AND FOR OTHER PURPOSES. 7 WHEREAS, the City approved a comprehensive budget for the City of Little Rock, Arkan- s sas, in Little Rock, Ark., Ordinance No. 20,078 (December 22, 2008); and. 9 WHEREAS, it is appropriate to adjust the ordinances to reflect operational changes in the io General Fund, and where necessary to authorize the increase or decrease in the fiscal year 2009 u line items for these and other matters; and, 12 WHEREAS, such adjustments were made in Little Rock, Ark., Ordinance No. 20,128 (Au- 13 gust 8, 2009), and Little Rock, Ark., Ordinance No. 20,175 (October 6, 2009), to reflect the 14 changed economic conditions with the State of Arkansas, and with the City; and, 15 WHEREAS, the City Manager and the Director of Finance & Treasurer, in compliance with 16 City budget and financial reporting policies, have reviewed these adjustments and recommend 17 them to the Board of Directors for approval, 18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 19 THE CITY OF LITTLE ROCK, ARKANSAS: 20 Section 1. General Fund. Section 4 of Little Rock, Ark., Ordinance No. 20,078 (December 21 22, 2008), as amended by Little Rock, Ark., Ordinance No. 20,128 (August 8, 2009), and by Lit - 22 tle Rock, Ark., Ordinance No. 20,175 (October 6, 2009), is hereby amended so the General Fund 23 Operating Resources amount will decrease by eight hundred eight thousand one hundred ninety - 24 seven dollars ($808,197) to one hundred thirty -four million five hundred and forty -one thousand 25 seven hundred sixty -nine dollars ($134,541,769), to reflect reductions in operating budgets for 26 General fund departments of eight hundred nine thousand three hundred twelve dollars 27 ($809,312), to the amount of one hundred thirty -four million five hundred forty thousand six 28 hundred fifty -four dollars ($134,540,654). 29 Section 2. General Fund. In the event that General Fund operating resources and other fi- 30 nancing sources exceed the operating expenditures and other financing uses of General Fund de- 31 partments at year end, the excess will be used to restore the funding of Community Programs [PAGE 1 OF 3] Ordinance to adjust the 2009 budget I project S 15T780 for domestic violence transitional housing up to eighty thousand dollars 2 ($80,000). 3 Section 3. City Manager Authority. To the extent that additional expenditure adjustment are 4 required, or revenue adjustments are required which do not exceed five percent (5 %) of the 5 amounts set forth in Little Rock, Ark., Ordinance No. 20,078 (December 22, 2008) as amended, 6 the City Manager is authorized to take any and all steps to adjust the City budget for 2009, pro - 7 vided that the Mayor and Members of the Board of Directors are notified in writing of any such 8 adjustment within five (5) working days of such action; and, provided further, that the Board of 9 Directors shall retain the authority to amend or repeal such action at the next special or regular 10 meeting. tt Section 4. Records. The Director of Finance & Treasurer is directed to maintain appro- 12 priate records which provide greater detail for the adjustments set forth in this ordinance as re- 13 flected in the materials provided to the Board of Directors for the October 20, 2009 meeting. 14 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, 15 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 16 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 17 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitu- 18 tional was not originally a part of the ordinance. 19 Section 6. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent 20 with this ordinance are hereby repealed to the extent of such inconsistency. 21 Section 7. Emergency. Due to extraordinary circumstances occasioned by national eco- 22 nomic events which have, among other things, mandated that the federal government take spe- 23 cial recovery measures, including but not limited to the appropriation of stimulus funds to assist 24 businesses and the American economy, the revenues of the City of Little Rock, particularly gross 25 receipts and compensating use taxes, have declined by extraordinary amounts of as much as ten 26 percent (1001o) of monthly forecasts; further, abnormally cool weather conditions during the 27 summer months of 2009 have drastically diminished utility franchise fees which are also a major 28 portion of City General Fund revenues; further, the change from land line telephone services to 29 the use of mobile telecommunications as the exclusive residential telephone service has drasti- 30 cally diminished telephone franchise revenues by a much as twenty -five percent (25016); all of 31 these decreases in General Funds revenues have necessitated dramatic adjustments to the 2009 [PAGE 2 OF 31 Ordinance to adjust the 2009 budget 1 City budget; because the City's ability to properly maintain its budgets and to account for its 2 funds is essential to maintain the public health, safety and welfare; an emergency is, therefore, 3 declared to exist and this ordinance shall be in full force and effect from and after the date of its 4 passage. 5 PASSED: October 20, 2009 6 ATTEST: 7 8 9 usan an ley, cting City Clerk 10 APPRO D AS TO LEGAL FORM: 11 12 13 Thomas M.
