HomeMy WebLinkAbout20182I 2 ORDINANCE NO. 20,182 3 AN ORDINANCE TO ESTABLISH THE RATE OF TAXATION OF 4 PROPERTY FOR THE CITY OF LITTLE ROCK FOR THE YEAR 2010 5 FOR VARIOUS FUNDS OF THE CITY OF LITTLE ROCK, ARKANSAS; 6 TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. 8 WHEREAS, pursuant to Ark. Code Ann. § 23 -73 -202 (West Supp. 2009), the Board of Di- g rectors is required to certify to the county clerk the rate of ad valorem property tax to be levied 10 on real and personal property within the City of Little Rock, Arkansas, for the current year; and, 11 WHEREAS, pursuant to Ark. Code Ann. § 14 -14 -904 (West Supp. 2009), upon the time re- 12 ceipt of this information from the City, the Pulaski County Quorum Court is mandated to make 13 such a levy at its regular November meeting in 2009; 14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 15 THE CITY OF LITTLE ROCK, ARKANSAS: 16 Section 1. The rate of taxation of real and personal property in the City of Little Rock, 17 Arkansas for certain City purposes are hereby fixed, established and levied as follows: 18 (a) For general purposes in order to carry on the affairs of the City Govern - 19 ment under Section 4, Article 12 of and Amendment 10 to the Constitution 20 of Arkansas of 1874, there is hereby levied a tax of five (5) mills; 21 (b) For the purpose of paying bonds and interest as may be required for the 22 bonds authorized in Little Rock, Ark., Ordinance No 18,941 (September 23 30, 2003), to repay the City of Little Rock, Arkansas, Capital Improve - 24 ment Bonds, approved at a special election held on November 4, 2003, 25 there is hereby levied a tax of three and three tenths (3.3) mills; 26 (c) For the purpose of paying Policemen's Pensions in accordance with provi- 27 sions of Amendment No. 31 to the Constitution of the State of Arkansas, a 28 tax of one (1) mill; 29 (d) For the purpose of Paying Firemen's Pensions in accordance with the pro - 30 visions of Amendment No. 31 to the Constitution of the State of Arkansas [PAGE 1 OF 3] Ordinance to levy ad valorem property taxes for 2010 1 adopted November 5, 1940, and Act 16 of the acts of the General Assem- 2 bly of the State of Arkansas for the year 1941, a tax of one (1) mill; 3 (e) For the purpose of maintaining the City Library, in accordance with the 4 provisions of Amendment No. 30 to the Constitution of the State of Ar- 5 kansas, a tax of three and three tenths (3.3) mills; 6 (f) For the purpose of paying bonds and interest as may be required for the 7 City of Little Rock, Arkansas, for Library System Capital Improvement 8 Bonds, a tax of two (2) mills. 9 Section 2. Since the City achieved equalization in 1989 under the provisions of Amendment 10 59 to the Arkansas Constitution, the tax rates are the same for both real and personal property. 11 Section 3. Because Pulaski County completed a county -wide reappraisal of property in 12 2006, the millage rates set forth in Section 1 of this Ordinance may be subject to the rollback 13 provisions of Amendment 59 to the Arkansas Constitution as determined by the Arkansas As- 14 sessment Coordination Department although such a rollback is not anticipated; however, to the 15 extent that the millage rates in Section 1 are ordered roll backed in accordance with state law, the 16 Board of Directors adopts and ratifies such millage rates. 17 Section 4. The City Clerk is hereby directed immediately to transmit a certified copy of this is Ordinance to the County Clerk of Pulaski County so that the taxes recited may be extended on 19 the tax books of Pulaski County and collected with the other taxes for the year 2009. 20 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, 21 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 22 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 23 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitu- 24 tional was not originally a part of the ordinance. 25 Section 6. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict 26 with any provision of this ordinance are hereby repealed to the extent of such conflict. 27 Section 7. Emergency.
