4 ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED JOHNSOY' -may u �
5 SHORT -FORM PD -C (Z- 8490), LOCATED AT 4314 ASHER AVENUE, LITTI
6 ROCK, ARKANSAS, AMEND THE OFFICIAL ZONING MAP OF THE C>E)F
7 OF LITTLE ROCK; AND FOR OTHER PURPOSES. 1 +

9 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CI`'
10 OF LITTLE ROCK, ARKANSAS:
11 Section 1. That the zoning classification of the following described property be changed from C -4 to
12 PD -C:
13 Lots 10 and 11 Block 3, Riffel and Holder's Addition to the City of Little Rock, Pulaski
14 County, Arkansas.

16 Section 2. That the approval of Johnson Short-form PD -C (Z- 8490), located at 4314 Asher Avenue is
17 subject to compliance with the following additional conditions:

19 That the preliminary site development plan/plat be approved as submitted, including all
20 staff comments and conditions as outlined in the Planning Commission Agenda Staff
21 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
22 in paragraph H and subject to additional conditions imposed at the Planning Commission
23 Public Hearing as amended by the applicant.

25 Section 3. That the preliminary site development plan /plat be approved as recommended by the
26 Little Rock Planning Commission.
27 Section 4. That the change in zoning classification contemplated for Johnson Short-form PD -C (Z-
28 8490), located at 4314 Asher Avenue is conditioned upon obtaining a final plan approval within the time
29 specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances.
30 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
31 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
32 necessary to affect and designate the change provided for in Section 1 hereof.
33 Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the
34 plan.

I Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause,
2 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
3 declaration or adjudication shall not affect the remaining portions of the ordinance which shall
4 remain in full force and effect as if the portion so declared or adjudged invalid or
5 unconstitutional was not originally a part of the ordinance.
6 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
7 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
