3 STREET, SOUTH MADISON STREET, MARYLAND AVENUE, AND ALLEY
4 RIGHTS -OF -WAY ABANDONMENTS LOCATED NORTH OF WEST 101h
5 STREET, SOUTH OF INTERSTATE 630 AND BETWEEN JONESBORO
6 DRIVE AND SOUTH MADISON STREET, IN THE CITY OF LITTLE ROCK,
7 ARKANSAS, AS PUBLIC RIGHT -OF -WAY; AND FOR OTHER PURPOSES.
8 WHEREAS, a request was made to vacate and abandon portions of South Monroe Street, South
9 Madison Street, Maryland Avenue, and alley rights -of -way abandonments located north of West 10`x'
10 Street, South of Interstate 630 and between Jonesboro Drive and South Madison Street, as public right -
11 of -way, pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54 -104; and
12 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have
13 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the right -of -way
14 abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise noted below;
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK, ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons portions of South Monroe
18 Street, South Madison Street, Maryland Avenue, and alley rights -of -way abandonments located north of
19 West 10th Street, South of Interstate 630 and between Jonesboro Drive and South Madison Street as
20 public right -of -way
21 Section 2. The City specifically reserves portions of the utility easements in the rights -of -way, with
22 automatic abandonment of the easements once the existing lines are relocated with new easements
23 established.
24 Section 3. The City specifically reserves the drainage easements to be maintained in the right -of -way
25 to convey storm water from adjacent property.
26 Section 4. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
27 records of the recorder of the Circuit Clerk in ex- officio recorder of Pulaski County, Arkansas.
28 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
29 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of the ordinance which shall remain in E f yl
31 effect as if the portion so declared or adjudged to be invalid or unconstitutional were
32 of the ordinance.

33 Section 6. Repealer. All laws, ordinances, resolutions, or parts of 1 —�
34 inconsistent with the provisions of this ordinance are hereby repealed to the extent of suc��`'
