That the zoning classification of the following described property be changed 14 from PCD to Revised PCD: 15 All of Block 7 of the Oak Terrace Addition and all of Block 10 of 16 McCarthy's Addition both in the SE '/4 of Section 9, Township 1 North, 17 Range 12 West of the City of Little Rock, Pulaski County, Arkansas. 18 Section 2. That the approval of James Mitchell School Revised Short-form PCD (Z- 5442 -D), 19 located at 2410 South Battery Street is subject to compliance with the following additional 20 conditions: 21 That the preliminary site development plan/plat be approved as submitted, 22 including all staff comments and conditions as outlined in the Planning 23 Commission Agenda Staff Report in paragraphs D, E, F and including any 24 conditions indicated in the staff analysis in paragraph H and subject to 25 additional conditions imposed at the Planning Commission Public Hearing as 26 amended by the applicant. 27 Section 3. That the preliminary site development plan /plat be approved as recommended by 28 the Little Rock Planning Commission. 29 Section 4. That the change in zoning classification contemplated for James Mitchell School 30 Revised Short-form PCD (Z- 5442 -D), located at 2410 South Battery Street is conditioned upon 31 obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36- 32 454 (e) of the Code of Ordinances. That the map referred to in Chapter 36 of the Code of Ordinances of the City of 2 Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in 3 the respects necessary to affect and designate the change provided for in Section 1 hereof. 4 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, 5 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 6 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 7 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional 8 was not originally a part of the ordinance. 9 Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are 10 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such 11 inconsistency. 12 Section S.
