3 AN ORDINANCE TO APPROVE A PLANNED ZONING DEVELOPMENT AND
4 ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED
5 CHRISTIAN BROTHER'S AUTOMOTIVE SHORT -FORM PD -C (Z- 8458),
6 LOCATED IN THE 15500 BLOCK OF CHENAL PARKWAY, LITTLE ROCK,
7 ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF
8 LITTLE ROCK; AND FOR OTHER PURPOSES.

10 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
11 OF LITTLE ROCK, ARKANSAS:
12 Section 1. That the zoning classification of the following described property be changed from 0-3
13 to PD -C:

15 PART OF THE FRACTIONAL (FRL.) NW1 /4 OF THE NWl /4 OF SECTION 6,
16 TOWNSHIP 1 NORTH, RANGE 13 WEST OF THE FIFTH PRINCIPAL OF
17 MERIDAN, PULASKI COUNTY, ARKANSAS BEING MORE PARTICULALRY

31 Section 2. That the approval of Christian Brother's Automotive Short-form PD -C, located in the
32 15500 Block of Chenal Parkway is subject to compliance with the following additional condition, ;

I Staff Report in paragraphs D, E, F and including any conditions indicated in the staff
2 analysis in paragraph 'H and subject to additional conditions imposed at the Planning
3 Commission Public Hearing as amended by the applicant.
4 • Evergreen plantings are to be planted along the western perimeter of the site in -lieu
5 of an opaque fence to serve as the screening mechanism.
6 • All lighting for the sign located along Chenal Parkway must be turned off by
7 midnight daily.
8 • There will be no Saturday hours of operation 120 days after receiving the businesses
9 final certificate of occupancy.
10 • There will be no electronic signage on the site.
11 • There will be no parking lot pole lighting and all lighting will be shielded downward
12 and into the site.
13 • There will be no outdoor vehicle storage or working on vehicles outdoors.
14 • All future users of the site are to abide by the same conditions as the approval for
15 Christian Brother's Automotive.
16 Section 3. That the preliminary site development plan/plat be approved as recommended by the
17 Little Rock Planning Commission.
18 Section 4. That the change in zoning classification contemplated for Christian Brother's Automotive
19 Short-form PD -C, located in the 15500 Block of Chenal Parkway is conditioned upon obtaining a final
20 plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of
21 Ordinances.
22 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
23 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
24 necessary to affect and designate the change provided for in Section 1 hereof.
25 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
29 ordinance.
30 Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
31 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
32 Section 8. That this Ordinance shall not take effect and be in full force until the final approval of the
33 plan.
