WHEREAS, Act 341 of 2009 (the "Act ") authorizes cities to increase penalties for violations of the City Code for the first time in over twenty years; and WHEREAS, the authorized penalty has been amended from a fine not exceeding $500.00 to $1,000.00, and from $250.00 to $500.00 for continuous violations; and WHEREAS, the effective date of Act 341 is July 31, 2009, ninety days after adjournment of the legislature. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Little Rock, Ark., Rev. Code § 1 -9 (c) is hereby amended to read as follows: (c) Except as otherwise provided, a person convicted of a violation of this Code shall be punished by a fine not exceeding one thousand dollars ($1,000.00), or double such sum for each repetition thereof. If the violation is, in its nature, continuous in respect to time, the penalty for allowing the continuance thereof is a fine not to exceed five hundred dollars ($500.00) for each day that the same is unlawfully continued. Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of this ordinance. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Section 4. Emergency Clause. Whereas, it is hereby found and determined that an increase in the penalty amounts authorized pursuant to Act 341 of 2009 is warranted in that it that it will act as a deterrent to city ordinance violations; therefore an emergency is hereby declared and this Ordinance shall take effect on August 1, 2009, one day after the effective date of its authorizing legislation.
