HomeMy WebLinkAbout201223 AN ORDINANCE TO AMEND CHAPTER 17, ARTICLE H OF THE LITTLE 4 ROCK REVISED CODE OF 1988 AS TO ADDITIONAL REQUIREMENTS OF 5 FOR - PROFIT FOOD ESTABLISHMENTSJO DECLARE AN EMERGENCY; 6 AND FOR OTHER PURPOSES. 7 8 WHEREAS, currently only non -profit food establishments are required to obtain a State Department 9 of Health permit before obtaining a business license from the City; and 10 WHEREAS, the Board of Directors has concluded that it would be beneficial to the health and public 11 safety of the City to require all food establishments to obtain a permit from the State Department of 12 Health before obtaining a business license from the City to enable the City to assure that all food 13 establishments have a license subject to regulation and to promote the public health and welfare. 14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK, ARKANSAS: 16 Section 1. Section 17 -58 of the City of Little Rock Revised Code of 1988 is hereby amended to read 17 as follows: 18 (a) All non -profit and for -profit food service establishments, including but not 19 limited to restaurants, mobile canteens, and caterers now or hereafter required to obtain a 20 State Department of Health food establishment permit shall also be required to obtain a 21 City business license. 22 (b) The required state permit must be presented to the treasury manager before 23 the business license can be issued. 24 (c) The fee for the business license shall be waived for all non - profit food 25 service establishments with the exception of non -profit corporations that operate as 26 private clubs and have acquired a permit from the State of Arkansas Alcoholic Beverage 27 Control Board. 28 (d) Any non - profit corporation that operates as a private club and has 29 acquired a permit from the State of Arkansas Alcoholic Beverage Control Board shall be 30 responsible for payment of the business license as set forth in this chapter. 31 Section 2. Severability. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Section 4. Emergency. In order to properly provide and support the public peace, health and safety of the City, it is essential that the City have an accurate record of all persons, firms, individuals and corporations conducting business within the City and that such persons, firms, individuals and corporations maintain their business licenses and required State permits; to ensure that food establishments obtain their proper State permits before obtaining their business licenses, this ordinance should be given effect immediately; an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
