AN ORDINANCE AMENDING CHAPTER 36.,
SECTION 36- 203.(8) OF THE CODE OF ORDINANCES
OF THE CITY OF LITTLE ROCK, ARKANSAS TO
EXTEND THE SUNSET PROVISION AN ADDITIONAL
FIVE (5) YEARS TO JULY 19, 2014 FOR PORTABLE
CLASSROOM BUILDINGS USED BY THE LITTLE
ROCK SCHOOL DISTRICT; AND FOR OTHER
PURPOSES.
WHEREAS, portable classroom buildings were determined to require a
conditional use permit on residentially zoned Little Rock School District properties after
passage of the current Zoning Ordinance; and
WHEREAS, Ordinance No. 15,710 was passed by the Little Rock School Board
of Directors on July 18, 1989 which allowed staff approval for placement of portable
classroom buildings on Little Rock School District campuses with a five (5) year sunset
provision; and
WHEREAS, that sunset provision has been extended by three successive five 95)
year periods and is to expire on July 19, 2009; and
WHEREAS, as a result of the Courts declaring the school district to have unitary
status and the State of Arkansas' expected expansion of the Pre -K program, more
students are attending schools in the immediate neighborhood of their home resulting in
the continued need for use of portable classroom buildings.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. That Chapter 36., Section 36 -203. of the Code of Ordinances "" ,
the City of Little Rock, Arkansas is hereby amended to read as follows: ; •'''�'`�_R�(f�
(g) Sunset provision. The board of directors hereby extends the
sunset provision of the zoning ordinance an additional five (5)
years to July 19, 2014, for portable school classrooms in the Little :, =�
Rock school district,

SECTION 2. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining portions of
the ordinance which shall remain in full force and effect as if the portion so declared or
adjudged invalid or unconstitutional was not originally a part of the ordinance.
SECTION 3. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
