3 AN ORDINANCE TO CONDEMN CERTAIN STRUCTURES IN THE CITY OF
4 LITTLE ROCK AS STRUCTURAL, FIRE AND HEALTH HAZARDS; PROVIDING FOR
5 SUMMARY ABATEMENT PROCEDURES; DIRECTING THE CITY ATTORNEY TO
6 TAKE SUCH ACTION AS IS NECESSARY TO RAZE AND REMOVE SAID
7 STRUCTURES; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

9 WHEREAS, certain structures in the City of Little Rock, Arkansas, have become run -down, dilapidated,
10 unsightly, dangerous, obnoxious and detrimental to the public welfare of the citizens of Little Rock; and
11 WHEREAS, the condition of these structures constitutes a serious structural, fire and health hazard; and
12 WHEREAS, such structures are a public nuisance and are dangerous to the health and safety of the occupants
13 or other persons and, further, are in such condition as to be dangerous to the lives, limbs and property of people in its
14 vicinity or those lawfully passing thereby; and
15 WHEREAS; such structures are declared a nuisance and immediate action is necessary to remedy these
16 situations and said buildings should be rehabilitated by the owners or razed either by the owners or the City of Little
17 Rock.
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
19 LITTLE ROCK, ARKANSAS.
20 Section 1. The Board of Directors hereby declares that the following structures constitute public nuisances.
21 The owners of the following described properties are hereby ordered either to begin rehabilitation by immediately
22 contacting the Department of Housing & Neighborhood Programs and entering into an agreement providing for the
23 immediate rehabilitation of the structures or to raze and remove said structures within twenty-four (24) hours and to
24 complete such removal within seventy-two (72) hours of the effective date of this Ordinance. While not required by
25 law to do so, the Department of Housing & Neighborhood Programs will immediately attempt to notify the owners
26 of the property listed below of the passage of this ordinance by certified mail or personal service.
27 The property on which the condemned structures are located by street address and legal description is hereafter
28 set forth with the name of the owners of record, as follows:
29 (1.) 4220 W 12`h Street
30 Part of the SW 1/4 of the SW 1 /4, Section 5 Township North, Range 12 West, Pulaski County, Arkansas described as
31 follows: Commencing at a point on the South line of said SW1/4, SW1/4, which is 626 feet West of the Southeast
32 comer of said SW1/4. Swl /4, thence North 30 Feet to the Line of West 12"' Street in the City of Little Rock and the
33 Point of Beginning; thence North parallel to the West boundary line of Lots 8 and 9, Block 5, Lucas Jansen's

43 Section 2. The conditions of the structures on the above - described property have been found to present
44 structural, fire and health hazards and are dangerous to the health and safety of the occupants or other persons, and
45 further, the structures are in such condition as to be dangerous to the lives, limbs and property of people in its
46 vicinity or those lawfully passing thereby.
47 Section 3. The City Attorney is hereby authorized to institute such proceedings against such persons as may
48 be necessary in order to enforce the provisions of this ordinance so as to remedy the unsightly and dangerous
49 conditions brought about as a result of the failure of the owners thereof to maintain this property.

I Section 4. The Department of Housing and Neighborhood Programs of the City of Little Rock is also
2 authorized to raze and remove said buildings and file and enforce a lien against said property for the cost of razing
3 and removing said structures pursuant to Section 20 -32 of the Little Rock Code of Ordinances.
4 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of
5 this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not
6 affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared
7 or adjudged to be invalid or unconstitutional were not originally a part of the ordinance.
8 Section 6. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the
9 provisions of this ordinance are hereby repealed to the extent of such inconsistency.
10 Section 7. Unless the provisions of this Ordinance are put into effect immediately, the public health, safety
11 and welfare of the citizens of Little Rock will be adversely affected; therefore, an emergency is hereby declared to
12 exist, and this ordinance shall be in full force and effect from and after its passage.
