2 AN ORDINANCE TO ABANDON TWO SANITARY SEWER EASEMENTS LOCATED
3 WITHIN SHACKLEFORD CROSSING ADDITION TO THE CITY OF LITTLE ROCK,
4 ARKANSAS, LOCATED IN THE 2800 BLOCK OF SHACKLEFORD ROAD; AND
5 FOR OTHER PURPOSES.
6 WHEREAS, a request was made to vacate two sanitary sewer easements located within Shackleford
7 Crossing Addition to the City of Little Rock, Arkansas, located in the 2800 block of Shackleford Road.
8 pursuant to the City's general police power authority under Ark. Code Ann. S 14 -54 -104; and
9 WHEREAS, the Board has determined that the easements are located entirely within Shackleford
10 Crossing, no other parties are affected by the easement abandonment, new easements have been
11 created and the sewer line has been relocated, and the Little Rock Sanitary Sewer Committee has
12 recommended and consented that the easements be abandoned.
13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
14 ROCK, ARKANSAS:
15 Section 1. The Board of Directors hereby releases, vacates, and abandons certain easements in
16 favor of the City of Little Rock for the use and benefit of Little Rock Sanitary Sewer Committee within
17 Shackleford Crossings Addition, Little Rock, Pulaski County, Arkansas, as set forth in Attachment A
18 hereto.
19 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real
20 estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
21 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
22 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
23 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
24 in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was
25 not originally a part of the ordinance.
26 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
27 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
28 inconsistency.

Little Rock, Pulaski County, Arkansas, filed in Book 1269, Page 261, and as Instrument

No. 80 -4902, respectively, more particularly described as follows:

Beginning at a point 257 feet East of the NW corner NE i/4 NE Y4, Section 16, T -1 -N, R-

13 -W; thence S31'15" W 442 feet; thence South 500 feet, thence S 71'30"W 315 feet

to the R/W of Interstate 430

Easement to extend 7.5 feet each direction (as measured at right angles) from

centerline of pipeline as constructed;

15 ft. sanitary sewer easement being the South 15 ft. of the West 485 ft. of the East
