3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDDING AND AUTHORIZE
4 THE CITY MANAGER TO ENTER INTO A SOLE SOURCE CONTRACT WITH NATU-
5 RAL ENCOUNTERS, INC. FOR A SERIES OF FREE - FLIGHT BIRD SHOWS AT THE
6 LITTLE ROCK ZOO; AND FOR OTHER PURPOSES.

8 WHEREAS, the Little Rock Zoo Director desires to present a new attraction and added value in
9 2009 for visitors to the Zoo, and
10 WHEREAS, after research by Zoo staff, it was determined that a series of free - flight bird shows
11 utilizing a variety of trained birds would be an educational and entertaining addition to Zoo activities
12 for next year that would increase Zoo revenues, and
13 WHEREAS, on November 10, 2008, the Zoo Board of Governors voted unanimously to recom-
14 mend that the City contract with Natural Encounters, Inc. to provide fifteen free - flight bird shows each
15 week at the Zoo over a period of five months in 2009, and
16 WHEREAS, competitive bidding should be waived owing to the unique nature of the bird show
17 program and therefore a contract should be awarded to Natural Encounters, Inc. as the sole source of
18 this entertaining and informative bird show program.
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
20 ROCK, ARKANSAS:
21 Section 1. Due to the unique nature of the desired free - flight bird show program, the
22 Board of Directors finds that competitive bidding should be dispensed with and that a contract for the
23 series of bird shows over a five -month period in 2009 should be awarded to Natural Encounters, Inc.,
24 which provides the handlers and the trained birds for the programs.
25 Section 2. The City Manager is hereby authorized to dispense with competitive bidding
26 and to enter into a sole source contract, in a form acceptable to the City Attorney, with Natural En-
27 counters, Inc. for the bird shows in the total amount of One Hundred Twenty Thousand Dollars
28 ($120,000.00).
29 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
30 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
31 declaration or adjudication shall not affect the remaining portions of the ordinance, which shall remain
32 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not
33 originally a part of the ordinance.
34 Section 5. Repealer. All ordinances and resolutions, and parts thereof, that are in con -
35 flict with any provision of this ordinance are hereby repealed to the extent of such conflict.
