HomeMy WebLinkAbout20037ORDINANCE NO. 20,037 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED STIFFT'S STATION SHORT -FORM PCD (Z- 8167 -B), LOCATED AT 1001 KAVANAUGH BOULEVARD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from C -3, General Commercial District and R -5, Urban Residential District to PCD: Lots 8, 9 10, 11, Block 6, Midland Hills Addition to the City of Little Rock, Pulaski County, Arkansas. And, Part of Lot 12, Block 6 Midland Hills Addition to the City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Beginning at the SE corner of said Lot 12; thence West along the North side of West Markham Street a distance of 64 feet; thence in a northwesterly direction of 152.2 feet to the point where the east and west line of Lot 12 intersect; thence along the east line of Lot 12, 171.5 feet to the point of beginning, said Lot being the E '/2 of Lot 12 and a strip of ground having a frontage 4 feet on Markham Street and extending in a northwesterly direction 152.2 feet to the intersection of the east and west lines of said Lot 12, located in Pulaski County, Arkansas. SECTION 2. That the approval Stifft's Station Short-form PCD (Z- 8167 -B), located at 1001 Kavanaugh Boulevard is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • No outdoor music is allowed to be played on the site. • The patio area square footage is to be included in the total square footage allowed on the site. • A pawnshop is excluded as an allowable use. • The sale of alcohol is limited to beer and wine to be sold in conjunction with a grocery or as a wine bar. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Stifft's Station Short-form PCD (Z- 8167 -B), located at 1001 Kavanaugh Boulevard is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
