HomeMy WebLinkAbout19996ORDINANCE NO. 19,996 AN ORDINANCE APPROVING MODIFICATION TO A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED LOT 10 NORTHWEST TERRITORY REVISED SHORT -FORM PCD (Z- 8042 -B), LOCATED ON THE NORTHEAST CORNER OF CANTRELL ROAD AND CHENAL PARKWAY, LITTLE ROCK, ARKANSAS, AMENDING ORDINANCE NO. 19,884 AND THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 19,884 passed on December 4, 2007, be amended to provide for modification of the Planned Zoning Development described as Lot 10 Northwest Territory Revised Short-form PCD (Z- 8042 -B), located on the Northeast corner of Cantrell Road and Chenal Parkway; SECTION 2. That the zoning classification of the following described property be changed from PCD to Revised PCD: Part of the SE '/4 NW '/4 of Section 15, T -2 -N, R -14 -W, Pulaski County, Arkansas, being more particularly described as: Beginning at the southwest corner of Lot 1, Northwest Territory Addition, an addition to the City of Little Rock, Pulaski County, Arkansas (Plat Book E, Page 949); thence S88 °34' 14 "E along the south line of said Lot 1, 273.88 feet to a point on the east line of said SE '/4 NW 1 /a; thence SOl °32'09 "W along said east line, 335.74 feet to a point on the north right of way line of Arkansas State Highway 10; thence N79 °45'52 "W along said north right of way line 160.74 feet to a point on the east right of way line of Chenal Parkway; thence northwesterly along said east right of way line following the arc of a 50.0 foot radius curve to the right, a chord bearing and distance of N40 °34'40 "W, 63.55 feet; thence northwesterly and continuing along said east right of way line, following the arc of a 622.96 foot radius curve to the left, a chord bearing and distance of N13 °48' 14 "W 273.52 feet to the point of beginning containing 70,912 square feet or 1.62 acres more or less. SECTION 3. That the approval of Lot 10 Northwest Territory Revised Short- form PCD (Z- 8042 -B), located on the Northeast corner of Cantrell Road and Chenal Parkway is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 4. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 5. That the change in zoning classification contemplated for - - - - -- is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 6. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 7. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 8. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 9. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
