HomeMy WebLinkAbout19995ORDINANCE NO. 19,995 AN ORDINANCE APPROVING MODIFICATION TO A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED ROWAN VILLAGE REVISED LONG -FORM PCD (Z- 8262 -A), LOCATED AT THE CURRENT TERMINUS OF ALDERSGATE ROAD AND EAST OF SHACKLEFORD ROAD, NEAR THE INTERSECTION OF OLD SHACKLEFORD ROAD, LITTLE ROCK, ARKANSAS, AMENDING ORDINANCE NO. 19,867 AND THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 19,867 passed on December 4, 2007, be amended to provide for modification of the Planned Zoning Development described as Rowan Village Revised Long -form PCD (Z- 8262 -A), located at the current terminus of Aldersgate Road and East of Shackleford Road, near the intersection of Old Shackleford Road; SECTION 2. That the zoning classification of the following described property be changed from PCD to Revised PCD: Part of the North '/2 of the Northwest '/4 of Section 15, T -1 -N, R -13 -W, Pulaski County, Arkansas said tract of land also being a part of the land platted as Cottage Homes Heights Subdivision in the City of Little Rock, Pulaski County, Arkansas, being more particularly described as follows: Starting at the Southwest corner of the Northwest '/4 Northwest '/4 of said Section 15; thence S87 058'00 "E along the south line of said NW '/4 NW '/4 a distance of 97.36 feet to the east right of way line of Shackleford Road, said point also being the point of beginning; thence along said east right of way line along a curve to the right having a radius of 282.5 feet, an arc distance of 183.19 feet and a chord bearing and distance of N17 °54'04 "W 180.0 feet; thence N01 °19'22 "E along said east right of way line a distance of 723.01 feet; thence S85 058'48 "E a distance of 52.76 feet; thence along a curve to the right having a radius of 401.08 feet, an arc distance of 211.01 feet and a chord bearing and distance of S71 °13'25 "E 208.59 feet; thence S57'09'1 1"E a distance of 209.87 feet; thence along a curve to the left having a radius of 358.72 feet, an arc distance of 179.09 feet and a chord bearing and distance of S73 °40'42 "E 177.23 feet; thence S87 °12'24 "E a distance of 371.54 feet; thence along a curve to the right having a radius of 353.86 feet an arc distance of 143.74 feet and a chord bearing and distance of S75 °36' 18 "E 142.76 feet; thence along a curve to the left having a radius of 293.86 feet, an arc distance of 119.02 feet and a chord bearing and distance of S75 033'12 "E 118.20 feet; thence S87 °42'57 "E a distance of 94.09 feet; thence along a curve to the left having a radius of 320.98 feet, an arc distance of 18.54 feet and a chord bearing and distance of S89 °25' 17 "E 18.54 feet to a point on the northerly right of way line of Aldersgate Road as shown on the plat of Tract 5, Ecumenical Retirement Center Addition (Plat E -836); thence S02 022'40 "W along the west line of said Tract 5, Ecumenical Retirement Center Addition a distance of 616.91 feet to the southwest corner of said Tract 5; thence N89 °01'03 "W along the south line of said NW 1/4 NW 1/4 a distance of 68.69 feet; thence N87 058'00 "W along the south line of said Cottage Homes Heights Subdivision (Plat Book 1, Page 97) a distance of 1200.26 feet to the point of beginning, containing 955,961 square feet or 21.946 acre more or less. SECTION 3. That the approval of Rowan Village Revised Long -form PCD (Z-8262- A), located at the current terminus of Aldersgate Road and East of Shackleford Road, near the intersection of Old Shackleford Road is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • Development of the property shall comply with the Declaration of Restrictions and Covenants ( "DRC ") between Developer and Camp Aldersgate, Inc. • The uses approved for the commercial lots are those allowed in C -3, General Commercial District excluding the following listed uses: Bar, lounge or tavern (except as part of a restaurant or hotel use), Cabinet or woodwork shop, College dormitory, College fraternity or sorority, 24 -hour community welfare or health center, Feed store, Group care facility, Lodge or fraternal organization, Mortuary or funeral home, Pawnshop, Private club with dining or bar service, Recycling facility, automated, Taxidermist, Ambulance service post, Bus station and terminal, Crematorium, Upholstery shop, furniture, Upholstery shop, auto, Appliance repair, excepting as part of a larger use, Auto glass or muffler shop, excepting as part of a larger use, Beverage store, excepting on primarily marketing wine and/or fine liquor, Parking, commercial lot or garage, Drive -in theater. Auto parts, sales with limited motor vehicle parts installation, Auto repair, Service /gas station, Convenience store or retail or wholesale fuel outlet. • The use of outdoor speakers or sound amplification systems is prohibited on the property except for one -half hour before and after the owner's or occupant's hours of being open to the general public. The operation of any such speaker and system is N limited to those that do not emit sound that is plainly audible from Camp Aldersgate or a distance of 200 feet or more from the source of such sound. • No freestanding (lighted or unlighted) pole signs in excess of 20 -feet is permitted on the property. The property's parking lot lights shall not exceed 30 feet in height or be directed towards adjoining properties or roadways. The property's parking lot lights shall be full cut off, metal halide fixtures that utilize 400 watt or less horizontal bulbs with flat lenses to control glare and over spill of lighting. No downward lighting fixtures shall be permitted on the property except those specifically designed to light parking areas, service drives, sidewalks, and areas necessary for the protection of persons or property, and none shall exceed, the height or foot - candle specifications of the property's parking lot lights. Signage for the remaining portions of the property shall comply with Section 36- 346(f) and 36 -347 of the Little Rock Code as currently enacted. The property's northern most out parcel shall contain no building mounted signage facing north or northeast. • A black chain -link security fence at least 8 feet in height along the dividing line between the property and Camp Aldersgate's property shall be constructed. • Use of outdoor speakers or sound amplification systems is strictly prohibited on the property except for % hour before and after the user's hours of being open to the general public. The operation of any such speaker or sound amplification system is limited to those that do not emit sound that is plainly audible from the dividing line between the property and Camp Aldersgate's property. SECTION 4. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 5. That the change in zoning classification contemplated for Rowan Village Revised Long -form PCD (Z- 8262 -A), located at the current terminus of Aldersgate Road and East of Shackleford Road, near the intersection of Old Shackleford Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 6. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 7. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 8. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. 3 SECTION 9. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
