3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF COMPETITIVE
4 BIDDING AND AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT
5 IN THE AMOUNT OF ONE HUNDRED EIGHTY -SIX THOUSAND, NINE HUNDRED
6 NINETY -SIX AND 24/100 DOLLARS ($186,996.24) WITH MOTOROLA, INC. AS
7 THE SOLE SOURCE PROVIDER FOR SOFTWARE UPGRADES TO EXISTING OUT -
8 OF- SERVICE PUBLIC SAFETY RADIOS FOR USE AS A DISASTER/SPECIAL EVENTS
9 CACHE; AND FOR OTHER PURPOSES.

11 WHEREAS, the City of Little Rock received $543,811.6 in FY2OO6 Department of Homeland Security
12 Grant Program funding which allows for communications system upgrades, and
13 WHEREAS, the program has been developed to upgrade out -of- service radios to be stored as a
14 cache for use during significant disaster incidents or special events, and
15 WHEREAS, competitive bidding should be waived and the contract awarded to Motorola, Inc. as the
16 sole source provider of the system upgrade, as Motorola application software is proprietary and the
17 only radio equipment that is fully and reliably compatible with our current radio system infrastructure.
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
19 ROCK, ARKANSAS:
20 Section 1. The Board of Directors finds that competitive bidding should be dispensed with in
21 the upgrade of existing out -of- service public safety radios to be used as a disaster/ special events cache
22 as part of the Department of Homeland Security Grand Program.
23 Section 2. The City Manager is hereby authorized to dispense with competitive bidding and to
24 enter into a contract with Motorola, Inc. for software upgrades of out -of- service radios of the Little
25 Rock Public Safety Departments in the amount of One Hundred Eighty -six Thousand, Nine Hundred
26 Ninety -six and 24/100 Dollars ($186,996.24).
27 Section 3. Funds for this purchase are available through Federal Department of Homeland
28 Security Grant Funding.
29 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
30 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
31 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
32 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
33 originally a part of the ordinance.
34 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict
35 with any provision of this ordinance are hereby repealed to the extent of such conflict.
