3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF COMPETITIVE
4 SELECTION AND AUTHORIZE THE CITY MANAGER TO EXECUTE A
5 PROFESSIONAL SERVICES AGREEMENT WITH STUCK ASSOCIATES ARCHITECTS
6 TO PROVIDE ARCHITECTURAL SERVICES FOR PHASE TWO CONSTRUCTION OF
7 THE LITTLE ROCK ANIMAL VILLAGE; AND FOR OTHER PURPOSES.

9 WHEREAS, the 2004 Capital Improvement Bond issue approved by the voters of the City of Little
10 Rock provided funds for improvements to the Little Rock Animal Services Facility including, but not
11 limited to, construction of a new shelter, and
12 WHEREAS, by publication of Request for Qualifications No. 4217, the City of Little Rock solicited
13 qualifications for architectural services for the design and construction of a new Animal Services
14 Facility, and
15 WHEREAS, Stuck Associates Architects ( "Architect ") was selected by the City as the most qualified
16 to provide the needed services, and an agreement with the Architect was executed on April 13, 2005
17 pursuant to Little Rock Resolution No. 11,821 for schematic design of a new state -of- the -art animal
18 shelter ( "Animal Village ") and for design development and construction oversight for Phase I of the
19 shelter construction project, and
20 WHEREAS, the City now has funding to expand the Animal Village by constructing a Meeting and
21 Education Room, a Veterinarian Office, and a Veterinarian Clinic with Intake Area pursuant to the city -
22 approved Phase II schematic design documents prepared by the Architect, and
23 WHEREAS, the City's agreement with Architect expired upon completion of Phase I construction of
24 the Animal Village, but additional architectural services are needed for design development and
25 construction oversight for Phase II of the shelter project, and
26 WHEREAS, it is impractical and unfeasible to have a company other than Architect provide
27 architectural services based upon the program information and schematic design prepared by
28 Architect, and
29 WHEREAS, the competitive selection process that is required for architectural services should be
30 waived, and an agreement executed with Stuck Associates Architects as the sole source provider of the
31 architectural services that are needed to construct Phase II of the Little Rock Animal Village.
32 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
33 ROCK, ARKANSAS:
34 Section 1. The Board of Directors finds that competitive selection should be dispensed with in
35 the purchase of additional architectural services for the Animal Village construction project, as an
36 exceptional situation exists and competitive selection is impractical and infeasible.

Section 2. The City Manager is hereby authorized to enter into an agreement with Stuck
Associates Architects for the purchase of architectural services for an amount not to exceed Twenty -
One Thousand, Five Hundred Dollars ($21,500.00) including maximum reimbursable expenses.
Section 3. Funds for these services are available from the Animal Village Construction Fund
No. SOOB357.
Section 4 Severability. In the event any title, section, paragraph, item, sentence, clause,
phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
originally a part of the ordinance.
Section 5 Repealer. All ordinances and resolutions, and parts thereof, which are in conflict
with any provision of this ordinance are hereby repealed to the extent of such conflict.
