Ordinance to Implement a Total Surcharge Per Ground Transportation Trip
Pursuant to the Little Rock Transportation Code
i WHEREAS, on September 20, 2005, the Board of Directors adopted a fuel surcharge
2 provision to the Little Rock Transportation Code which provides that a total surcharge
3 per trip, as set by the Board of Directors, may be charged to each load if the Board is
4 asked to do so, and it is determined that an increase in the price of fuel during the
s time period of January 1 of any given year to the date of that same year when the sur-
6 charge is approved justifies such change, and
7 WHEREAS, Greater Little Rock Transportation Services has requested a total surcharge
8 per trip, and
9 WHEREAS, due to the dramatic and continued increase in the price of gasoline since
to January 1, 2008, the Board of Directors feels it is necessary to implement a total sur-
e 1 charge per trip of $1.00 pursuant to Little Rock, Ark., Rev. Code § 34- 43(b)(5)c.
12 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
13 LITTLE ROCK, ARKANSAS:
14 Section 1. Due to the dramatic and continued increase in the price of gasoline since
15 January 1, 2008, at the request of Greater Little Rock Transportation Services, the
16 Board of Directors hereby implements a total surcharge per trip of $1.00 pursuant to
17 Little Rock, Ark., Rev. Code § 34- 43(b)(5)c.
18 Section 2. This total surcharge per trip of $1.00 shall in effect from May 13, 2008
19 through June 20, 2008.
20 Section 3. Severabi/ity. The provisions of this Ordinance are hereby declared to be
21 severable. If any provision shall be held to be invalid or to be inapplicable to any per-
22 sons or circumstances, such invalidity or inapplicability shall not affect the remainder
23 of the provisions of this Ordinance.
24 Section 4. Repealer. All laws and parts of laws are hereby repealed to the extent of
25 such inconsistency with this ordinance.

I Section 5. Emergency Clause. The Board of Directors has determined that it is crucial
2 to the public health, safety, and welfare, that there be in place meaningful tran5porta-
3 tion service from vehicles for hire that are available to citizens and visitors to the City-
4 further, that increases in the cost of fuel can be so dramatic as to threaten the ability
5 of operators and drivers to provide this service; further, that since january 1, 2008, the
6 cost of gasoline has dramatically increased, which would make the application of a
7 surcharge per trip for fuel expense appropriate; an emergency is, therefore, declared
s to exist and this ordinance shall be in full force and effect from May 13, 2008 through
