SECTION 1. That the zoning classification of the following described property be changed from I -2 to PID: Tract D; Lots 5, 8 and the East 10 feet of an alley West of and adjacent - closed, Block 8, Intercity Addition to the City of Little Rock, Pulaski County, Arkansas. Tract E; The east 75 feet of Lots 9, 10, 11 and 12, Block 8, Intercity Addition to the City of Little Rock, Pulaski County, Arkansas. Less and except: a part of Lot 6, Block 8 of Intercity Addition to the City of Little Rock, Pulaski County, Arkansas being more particularly described as follows: Commencing at the southeast corner of said Lot 6; thence along the south line of said Lot 6, also being the existing northern right of way of West 34th Street, S63 056'32 "W, 32.057 meters to a point of the proposed eastern right of way of Mabelvale Pike and the point of beginning; thence continuing along said existing right of way S63 °56 "32 "W, 6.796 meters to the existing eastern right of way of Mabelvale Pike; thence along said existing eastern right of way N14 °13'33 "E, 7.054 meters to the proposed eastern right of way of Mabelvale Pike; thence along said proposed right of way S63 °49'30 "E, 8.735 meters to the existing eastern right of way and the point of beginning. SECTION 2. That the approval of Calvary Bread of Life Ministries Short-form PID (Z- 8308), located between West 33`d and West 34"' fronting Jane Street and Mabelvale Pike Road is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Calvary Bread of Life Ministries Short-form PID (Z- 8308), located between West 33`d and West 34th fronting Jane Street and Mabelvale Pike Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. 5everability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
