AN ORDINANCE RECLASSIFYING PROPERTY
LOCATED IN THE CITY OF LITTLE ROCK,
ARKANSAS, AMENDING THE OFFICIAL ZONING
MAP OF THE CITY OF LITTLE ROCK, ARKANSAS;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE, ROCK, ARKANSAS.
SECTION 1. That the zone classification of the following property be and is
hereby changed as indicated:
Z- 4159 -A — Described as part of the SE '/4 NE '/4 and part of the NE '/4 SE
'/4 of Section 35, T -1 -N, R -13 -W, Little Rock, Pulaski County, Arkansas,
more particularly described as: Commencing at the NW corner of the SE
'/4 NE' /4 of Section 35; thence S00 °58'00" W, along the West line of said
SE '/4 NE ' /4, 1,012.8 feet to the point of beginning; thence N66'03'1 I " E,
273.32 feet; thence S16 °07'00" E, 150.27 feet; thence S29 °33'27" E,
201.07 feet; thence S38 056'25" E, 144.56 feet to a point on the South line
of said SE '/4 NE ' /4; thence East along the South line of said SE '/4 NE '/4,
36.38 feet; thence S15 °31'00" E, 45.15 feet to a point on the North right -
of -way line of U.S. Interstate Highway 30; thence S61 °37'30" W, along
the North right -of -way line of said highway 615.0 feet to a point on the
West line of the NE '/4 SE ' /4; thence N00 °58'00" E along the West line of
the NE '/4 SE '/4 and the SE '/4 NE ' /4, 656.60 feet to the point of beginning,
containing 5.422 acres, more or less: From "C -4" Open Display District
to "C -3" General Commercial District. (North side of Interstate 30,
approximately 1,000 feet west of Chicot Road.)
LESS AND EXCEPT:
The West 50 feet of the above described property (where adjacent to R -2
zoning) be zoned "OS" Open Space District.
SECTION 2. That the zoning of the above described property is subject to the
following conditions which were proposed by the applicant for the property described in
Section 1 of this ordinance and which shall be covenants running with the land to bind
subsequent grantees of the property:
• The West 50 feet of the property (where adjacent to R -2 zoning) will be
undisturbed and zoned OS.
• Any portion of the property which falls within the floodway will also be
zoned OS.
SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock and designated district map be and is hereby amended to the
extent and in the respects necessary to affect and designate the change provided for in
Sections 1 and 2 hereof.
SECTION 4. That the Ordinance shall take effect and be in full force 30 days
after the date of its passage and approval.
SECTION 5. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining portions of
the ordinance which shall remain in full force and effect as if the portion so declared or
adjudged invalid or unconstitutional was not originally a part of the ordinance.
SECTION 6. Repealer. All laws, ordinances, resolutions, or parts of the same,
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
