CODE CHAPTER 32, ARTICLE VI, 532 -301 - - §32 -411 (1988); TO CLARIFY TYPES OF PARKING AVAILABLE FOR VEHICLES WITHIN THE CITY LIMITS AND HOLIDAYS, TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the City has established by ordinance the types of parking available to motor vehicles parked in metered, time zone, and unmetered restricted parking spaces within the city limits; and WHEREAS, after incremental changes to the parking code over the years, it has been determined that legislation to clarify the various parking types available in the City is necessary and appropriate; and WHEREAS, the deletion of Columbus Day and the addition of Martin Luther King, Jr.'s and Robert E. Lee's birthday as parking holidays more closely conforms to the State holiday list and lessens confusion as to parking meter payment on those days; and WHEREAS, adding authority to the existing city code to impound vehicles parked in fire lanes adjacent to shopping centers and commercial enterprises which are privately owned but used by the public will give the City an additional tool to use as necessary to keep fire lanes clear. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Little Rock, Ark. Rev. Code 5 32 -301 (1988) -32 -323 is hereby amended to read as follows: DIVISION 1. GENERALLY Section 32 -301. Penalties. The penalty for violation of overtime parking in all metered and time zone restricted parking areas shall be: (a) Fifteen dollars ($15.00) if paid within thirty (30) days of the issuance of the ticket; (b) Fifty dollars ($50.00) if paid after thirty (30) days of the issuance of the ticket, or after conviction in district court for violation of city parking ordinances. A combination ticket and envelope shalt be provided at the issuance of a violation citation for the convenience of motorists. The penalty shall be paid by placing such sum in the penalty box attached to the parking meters, or by paying the fine to the city. PAGE 1 OF 22] ORDINANCE To Amend LR Rev. Code Chapter 32, Article VI I Sec. 32 -302. Handicapped parking citations. 2 The police department may issue citations for vehicles which do not legally 3 display the special tag or certificate for a handicapped or disabled person provided for 4 in the Handicapped Persons Access Act to Park Act of 1985 [A.C.A. 5 27 -15 -301 et seq.] 5 which are parked in areas designated in accordance with such act for the exclusive use 6 of handicapped persons. 7 Any vehicle found to be parked in an area designated for the exclusive use of 8 handicapped persons as provided for under A.C.A. 5 27 -15 -301, et seq., or which is 9 found to be parked in an area designated for the exclusive use of handicapped persons, 10 if operated by a person who is not a handicapped person, while not being used for the 11 actual transporting of a handicapped person, shall be subject to impoundment by the 12 police department. In addition thereto, the owner of such vehicle shall upon conviction 13 be subject to a fine of one hundred dollars ($100.00) for each offense, plus applicable 14 towing, impoundment, and related fees as welt as court costs. 15 16 Sec. 32 -303. Suspension of certain sections. 17 The provisions of section 32 -403 and sections 32 -405 through 408, the portions 18 therein pertaining to parking in alleys, shall be suspended to permit unlimited free 19 parking, except for the Little Rock Municipal Airport, on the following days only: 20 (1) Saturday. 21 (2) Sunday. 22 (3) Memorial Day. 23 (4) Labor Day. 24 (5) Presidents' Day. 25 (6) Veterans' Day. 26 (7) July 4. 27 (8) Thanksgiving. 28 (9) Friday after Thanksgiving. 29 (10) December 25. 30 (11) New Year's Day. 31 (12) Dr. Martin Luther King, Jr.'s Birthday and Robert E. Lee's Birthday 32 33 Sec. 32 -304. Manner of parking. 34 (a) Except as otherwise provided in this section, every vehicle stopped or 35 parked upon a roadway where there are adjacent curbs shall be stopped or parked with ORDINANCE PAGE 2 OF 22] To Amend LR Rev. Code Chapter 32, Article VI I the right -hand wheels of the vehicle parallel to and within eighteen (18) inches of the 2 right -hand curb. 3 (b) Parking of vehicles with the left -hand wheels adjacent to and within 4 eighteen (18) inches of the left -hand curb of a one -way roadway is allowed. 5 (c) In the case of angle or diagonal parking, no person shall stand or park a 6 vehicle other than with the front of such vehicle directed toward the front or curb of 7 the angle or diagonal parking space. 8 9 Sec. 32 -305. Signs or marking indicating angle parking. 10 The City Manager or the manager's designee shall determine upon what streets 11 angle parking shall be permitted and shall mark or sign such streets. Such angle parking 12 shalt not be indicated upon any federal -aid or state highway within the city unless the 13 state highway commission has determined by resolution or order entered in its minutes 14 that the roadway is of sufficient width to permit angle parking without interfering with 15 the free movement of traffic. 16 17 Sec. 32 -306. Obedience to angle- parking signs or markings. 18 Upon those streets which have been sign marked by the City Manager or the 19 manager's designee for angle parking no person shall park or stand a vehicle other than 20 at the angle to the curb or the edge of the roadway indicated by such signs or 21 markings. 22 23 Sec. 32 -307. Permit for loading or unloading at angle to curb. 24 The City Manager or the manager's designee may issue special permits to 25 permit the backing of a vehicle to the curb for the purpose of loading or unloading 26 merchandise or materials subject to the terms and conditions of such permit. Such 27 permits may be issued either to the owner or lessee of real property or to the owner of 28 the vehicle and shall grant to such person the privilege as therein stated and 29 authorized herein. No person shall back a vehicle to the curb for the purpose of loading 30 or unloading except according to the terms of such a permit. 31 32 Sec. 32 -308. Parking near walkways in parking lots; insurance required for parking lot 33 operators. ORDINANCE PAGE 3 OF 22] To Amend LR Rev. Code Chapter 32, Article VI I (a) In this section "parking lot" means any building or area or space of ground 2 in the city where vehicles of any nature are parked for a consideration paid to the 3 person in the business of operating the parking tot. 4 (b) It shall be a misdemeanor for the owner or operator of any parking lot to 5 permit parking of any vehicle on the lot so that the vehicle is closer than eighteen (18) 6 inches to the sidewalk or the walkway used by pedestrians. 7 (c) Each person, firm or corporation operating a private parking lot within the 8 city is hereby required to carry a policy or policies of insurance to indemnify any 9 person or persons parking vehicles on the parking lot in question, against toss by fire or 10 theft, or property damage to a vehicle occurring white the vehicle in question is parked 11 on the parking tot. 12 It is hereby declared to be a misdemeanor for any person, firm, or corporation 13 to operate a parking lot without securing and maintaining in force during the operation 14 of said parking lot, the insurance as required above, and each separate day's operation 15 in violation hereof shall constitute a separate offense. 16 (1) The insurance shalt be written by some approved insurance company and 17 shall be in an amount reasonably sufficient to indemnify persons parking vehicles on 18 said parking lots as said amount may be fixed from time to time by the city collector 19 provided that the minimum insurance carried shalt be two thousand five hundred 20 dollars ($2,500.00). Provided, however, that in lieu of insurance against loss from 21 property damage, any parking tot operator may furnish to the city collector a surety 22 bond written by an approved corporation in the minimum amount of two thousand five 23 hundred dollars ($2,500.00); said surety bond to guarantee payment up to two 24 thousand five hundred dollars ($2,500.00) of any judgment that may be recovered 25 against said parking tot operator for property damages suffered by the owner of any 26 vehicle which is parked in the custody of any parking lot operator. 27 (2) All such policies of insurance or authenticated copies, satisfactory to the 28 city collector, shall be kept on file in the office of the city collector. 29 The insurance coverage required in the foregoing section shall apply only to 30 those persons who park their vehicles on said parking lots for compensation to the 31 parking lot operator. The city collector is hereby directed to refuse to issue a parking 32 lot operators' license to any applicant until and unless such applicant furnishes to the 33 collector an appropriate insurance policy in a sufficient amount as required by this 34 chapter. ORDINANCE PAGE 4 OF 22] To Amend LR Rev. Code Chapter 32, Article VI 1 2 Sec. 32 -309. Restrictions. 3 (a) No person shall stop, stand, or park a vehicle, except when necessary to 4 avoid conflict with other traffic or in compliance with the directions of a police officer 5 or traffic - control device, in any of the following places: 6 (1) On a sidewalk. 7 (2) In front of a public or private driveway. 8 (3) Within an intersection. 9 (4) Within fifteen (15) feet of a fire hydrant. 10 (5) On a crosswalk. 11 (6) Within twenty (20) feet of a crosswalk at an intersection. 12 (7) Within thirty (30) feet upon the approach to any flashing beacon, stop 13 sign, or traffic- control signal located at the side of a roadway. 14 (8) Between a safety zone and the adjacent curb or within thirty (30) feet of 15 points on the curb immediately opposite the ends of a safety zone, unless 16 the local traffic authority indicates a different length by signs or 17 markings. 18 (9) Within fifty (50) feet of the nearest rail of a railroad crossing. 19 (10) Within twenty (20) feet of the driveway entrance to any fire station and 20 on the side of a street opposite the entrance to any fire station within 21 seventy -five (75) [feet] of the entrance when properly signposted. 22 (11) Alongside or opposite any street excavation or obstruction when stopping, 23 standing, or parking would obstruct traffic. 24 (12) On a roadway side of any vehicle stopped or parked at the edge of a curb 25 or street. 26 (13) Upon any bridge or other elevated structure upon a highway or within a 27 highway tunnel. 28 (14) At any place where official signs prohibit stopping. 29 (b) No person shall move a vehicle not owned by the person into any such 30 prohibited area or away from a curb a distance that is unlawful. 31 (c) The penalty for violation of overtime parking in unmetered restricted 32 parking areas in this section shall be: 33 (1) Thirty dollars ($30.00) if paid within thirty (30) days of the issuance of the 34 ticket; ORDINANCE PAGE 5 OF 22] To Amend LR Rev. Code Chapter 32, Article VI 1 (2) Forty -five dollars ($45.00) if paid after thirty (30) days of the issuance of 2 the ticket, or after conviction in district court for violation of city parking 3 ordinances. 4 A combination ticket and envelope shall be provided at the issuance of a 5 violation citation for the convenience of motorists. The penalty shall be paid by placing 6 such sum in the penalty box attached to the parking meters, or by paying the fine to 7 the city. F 9 Sec. 32 -310. Obstructing traffic. 10 No person shall stop, stand or park any vehicle upon a street, other than an 11 alley, in such a manner or under such conditions as to leave available less than ten (10) 12 feet of the width of the roadway for free movement of vehicular traffic, except that a 13 driver may stop temporarily during the actual loading or unloading of passengers or 14 when necessary in obedience to traffic regulations or traffic signs, or signals of a police 15 officer. 16 17 Sec. 32 -311. Parking in alleys. 18 (a) It is hereby unlawful for any person to park, stand or stop a vehicle in any 19 alley except an alley used for commercial purposes and then only for such time as 20 necessary to toad and unload the vehicle. Commercial vehicles parked in an alley for 21 loading and unloading shall be clearly identified with permanent signage on the 22 exterior of the vehicle indicating the name and address of the business. Under no 23 circumstances shall a vehicle be parked or stopped in an alley in such a manner as to 24 have less than ten (10) feet of available roadway width for the free movement of 25 vehicular traffic, or to block the driveways of abutting properties. 26 (b) The penalty for violation of this provision shall be: 27 (1) Thirty dollars ($30.00) if paid within thirty (30) days of the issuance of the 28 ticket; 29 (2) Forty -five dollars ($45.00) if paid after thirty (30) days of the issuance of 30 the ticket, or after conviction in district court for violation of city parking 31 ordinances. 32 A combination ticket and envelope shalt be provided at the issuance of a 33 violation citation for the convenience of motorists. The penalty shall be paid by placing 34 such sum in the penalty box attached to the parking meters, or by paying the fine to 35 the city. ORDINANCE PAGE 6 OF 22] To Amend LR Rev. Code Chapter 32, Article VI I 2 Sec. 32 -312. Parking for certain purposes prohibited. 3 No person shall park a vehicle upon any roadway for the principal purpose of: 4 (1) Displaying such vehicle for sale or advertising. 5 (2) Washing, greasing, or repairing such vehicle, except repairs necessitated 6 by an emergency. 7 8 Sec. 32 -313. Parking on narrow streets. 9 The City Manager or manager's designee may erect signs indicating no parking 10 upon either or both sides of any street when such parking would interfere with traffic 11 or create a hazardous situation. When official signs prohibiting parking are erected 12 upon streets as authorized herein, no person shall park a vehicle upon any such street 13 in violation of any such sign. 14 15 Sec. 32 -314. Standing or parking on one -way roadways. 16 In the event a highway includes two (2) or more separate roadways and traffic 17 is restricted to one (1) direction upon any such roadway, no person shall stand or park 18 a vehicle upon the left -hand side of such one -way roadway unless signs are erected to 19 permit such standing or parking. The City Manager or the manager's designee may 20 determine when standing or parking may be permitted upon the left -hand side of any 21 such one -way roadway and to erect signs giving notice thereof. 22 23 Sec. 32 -315. Stopping, standing, or parking near hazardous or congested places. 24 The City Manager or manager's designee may determine and designate by 25 proper signs places in which the stopping, standing, or parking of vehicles would create 26 an especially hazardous condition or would cause unusual delay in traffic. When official 27 signs are erected at hazardous or congested places as authorized herein no person shalt 28 stop, stand, or park a vehicle in any area or designated place. 29 30 Sec. 32 -316. Parking on city -owned or city- controlled property prohibited. 31 (a) When signs are erected thereon giving notice thereof it shall be unlawful 32 for any person to park or cause to be parked any vehicle upon any property owned by 33 or under the control of the city or any board, agency or commission of the city, except 34 in areas designated for public parking generally. Code Chapter 32, Article VI I (b) Any vehicle parked in violation of the provisions of subsection (a) may be 2 removed by the police department from the property in question to the nearest garage 3 or other place of safety or to a garage designated or maintained by the police 4 department. 5 6 Sec. 32 -317. Fire lanes. 7 (a) The City Manager or the manager's designee, upon the written 8 recommendation of the chief of the fire department, is hereby authorized to designate 9 fire lanes in any public street or facility and, or upon any private property by the 10 proper placement of signs thereon. When such signs are erected giving notice thereof, 11 no person shall stop, stand or park any vehicle within any fire lane so designated. 12 Vehicles parked within the fire lane so designated are subject to impoundment by the 13 police department. 14 (b) Any person violating the provisions of this section shalt be guilty of a 15 misdemeanor and upon conviction thereof shalt be fined in a sum not less than ten 16 dollars ($10.00) nor more than one hundred dollars ($100.00), plus applicable towing, 17 impoundment, and related fees as well as court costs. 18 19 Sec. 32 -318. Stopping, standing, parking of buses. 20 (a) Except in the operation of a charter or special bus, the operator of a bus 21 shall not stop, stand or park any bus upon any street other than at a bus zone, or any 22 other location commonly used to take on and discharge passengers. 23 (b) Except in the operation of a charter or special bus, the operator of a bus 24 shall not stop such vehicle upon any street at any place for the purpose of loading or 25 unloading passengers or their baggage other than at a bus stop, bus stand, or passenger 26 loading zone or any other location commonly used for discharging and picking up 27 passengers. 28 (c) The operator of a bus shall enter a bus stop, bus stand or passenger 29 loading zone or other location where passengers are normally discharged or picked up 30 in such manner that the bus, when stopped to load or unload passengers or baggage, 31 shall be in a position as close to the curb as possible, so as not to impede unduly the 32 movement of other vehicular traffic. 33 34 ORDINANCE PAGE 8 OF 22] To Amend LR Rev. Code Chapter 32, Article VI I Sec. 32 -319. Unattended motor vehicles. 2 No person driving or in charge of a motor vehicle shall permit it to stand 3 unattended without first stopping the engine, locking the ignition and removing the 4 key, or when standing upon any perceptible grade without effectively setting the brake 5 thereon and turning the front wheels to the curb or side of the highway. 6 7 Sec. 32 -320. Obtaining parking accommodations by fraud. 8 (a) No person shall park a vehicle on any publicly owned parking lot or facility 9 without paying for such parking accommodation, or after parking a vehicle thereon 10 remove the vehicle from such parking lot or facility without paying for such parking 11 accommodation, with intent to defraud the operator thereof. 12 (b) Evidence that a person left the premises of a parking lot or facility 13 referred to in subsection (a) hereof without paying or offering to pay for such parking 14 accommodation shall be prima facie proof that such person obtained such parking 15 accommodation with intent to defraud the operator of such parking lot or facility. 16 17 Sec. 32 -321. Park closing hours. 18 (a) It shall be unlawful for any person to park a motor vehicle or to be on park 19 grounds between 10:00 p.m. and 5:00 a.m., unless the hours are otherwise posted. This 20 provision shall not apply to through traffic on public streets within the parks. 21 (b) The director of parks and recreation shall have the authority to extend 22 park hours for approved scheduled events. 23 24 Sec. 32 -322. Immobilization of automobiles with delinquent fines. 25 (1) A motor vehicle, parked upon the public way at any time may, by or under 26 the direction of an officer or member of the Little Rock Police Department, or by the 27 city manager, or the manager's designee, be immobilized in such a manner as to 28 prevent its operation, if: 29 (a) There are five (5) or more outstanding or otherwise unsettled parking 30 violation notices for tickets that have been issued within the previous 31 twelve (12) months which are over thirty (30) days old, or warrants 32 issued for such violation pending against the owner of such motor 33 vehicle; or 34 (b) There is an amount equal to two hundred fifty dollars ($250.00) or 35 more of unpaid parking violation fines, or costs, or both, that have ORDINANCE PAGE 9 OF 22] To Amend LR Rev. Code Chapter 32, Article VI I been issued within the previous twelve 12 ( ) months, pending against 2 the owner of such motor vehicle. 3 (2) Upon immobilization of such motor vehicle, the officer or employee 4 shall cause to be placed on such vehicle, in a conspicuous manner, notice sufficient to 5 warn any individual that the vehicle has been immobilized and that any attempt to 6 move such vehicle might result in damage to such vehicle. In addition to any other 7 notice the owner of the motor vehicle has received prior to the immobilization, as soon 8 as practicable, the city shalt inform the owner of the immobilized vehicle of the nature 9 and circumstances of the prior outstanding or unsettled traffic violation notices or 10 warrants for which, or on account of which, such vehicle was immobilized. 11 (3) The owner of such immobilized vehicle, or other authorized person, shall 12 be permitted to secure release of the vehicle upon: 13 (a) Depositing 14 1. The collateral required for his appearance in the appropriate court of 15 competent jurisdiction to answer for each violation; or 16 2. The amount of the fine or penalty for each violation for which there is an 17 outstanding or otherwise unsettled traffic violation notice or warrant; and 18 (b) The payment of the fees as renuirPri hx/ thic carfinn 19 (4) The owner of an immobilized vehicle, or a person with written 20 authorization to do so, shall have the right to a post- immobilization hearing to 21 determine the validity of such immobilization, towing, and any towing or storage 22 charges. Such hearing must be requested within fifteen (15) days after the vehicle is 23 immobilized and shall be conducted by a hearing officer appointed by the city manager 24 to conduct such hearings within seventy -two (72) hours after receipt of the request. 25 The post- immobilization hearing is civil in nature and will not be used to determine or 26 adjudicate any citation issued relative to any immobilized vehicle. Procedures for the 27 conduct of the hearing shall be established by the city manager and shall be provided 28 to the owner, or the owner's authorized representative, upon receipt of the hearing 29 request. 30 (5) Provided the motor vehicle is not parked in an emergency, handicapped, 31 or otherwise specially marked zone, including but not limited to lanes in which parking 32 is prohibited during certain periods of time, the immobilizing device or mechanism 33 shall remain in place for twenty -four (24) hours unless the owner has complied with 34 subsection (3) of this section. If such compliance has not occurred within the twenty - 35 four (24) hours, the vehicle shall be towed and impounded at the city impound lot. ORDINANCE PAGE 10 OF 22] To Amend LR Rev. Code Chapter 32, Article A 1 (6) If the immobilization occurs when a vehicle is parked in an emergency, 2 handicapped, or otherwise specially marked zone, including but not limited to lanes in 3 which parking is prohibited during certain periods of time and no further delay can be 4 reasonably tolerated, towing may occur immediately, and the owner of such vehicle is 5 subject to towing and impounding fees. City towing and storage fees shall be paid, 6 along with fines and fees specified in this ordinance, before the owner of such vehicle, 7 or the owner's authorized person or agent, shall be permitted to repossess or secure 8 the release of the vehicle. 9 (7) Notwithstanding any other provision of this section, if a vehicle has been 10 immobilized in the previous twelve (12) months for failure to settle outstanding parking 11 violations, or amounts of fines and costs, as set forth in this ordinance, the automobile 12 shall be towed to the city impound lot at the owner's expense, and shall not be 13 released until the owner has complied with all the provisions of this section including, 14 but not limited, the payment of all outstanding fines, fees and costs. 15 (8) (i) The owner of an immobilized vehicle shall be subject to a fee of one 16 hundred dollars ($100.00) for such immobilization; and, 17 (ii) The owner of an immobilized vehicle that is towed shall be subject to any 18 towing and storage fees and costs. 19 (9) A notice, printed on highly visible paper or other material, shall be 20 attached to the vehicle in a conspicuous place, and shall read substantially as follows: 21 WARNING! 22 DO NOT MOVE THIS VEHICLE 23 ATTEMPTS TO OPERATE THIS VEHICLE WHILE THE IMMOBILIZING DEVICE 24 IS ATTACHED MAY RESULT IN SERIOUS DAMAGE TO THE VEHICLE OR 25 SERIOUS BODILY INJURY TO THE PERSON ATTEMPTING TO OPERATE THE 26 VEHICLE. 27 This vehicle has been immobilized by the City of Little Rock for 28 violations of the Municipal Code concerning parking violations. 29 To secure the release of the vehicle, payment shall be made for all 30 outstanding parking violations, parking warrants, and the 31 immobilization or impoundment fee, or both. An additional cost of fifty 32 dollars ($50.00) shall be charged and paid for releases that occur after 33 normal business hours and holidays. 34 Arrangements for release of this vehicle may be made by calling the: ORDINANCE [PAGE 11 OF 22] To Amend LR Rev. Code Chapter 32, Article VI 1 (1) Parking Enforcement Section at (phone number) 2 between 9:00 a.m. and 4:00 p.m., Monday through 3 Friday; or 4 (2) The Little Rock Police Department (Desk Sergeant) at 5 (phone number) at all other hours and on Saturdays, 6 Sundays, and holidays. 7 ATTENTION, VEHICLE OWNER: You are hereby advised of your rights to 8 request a prompt hearing to determine the validity of the 9 immobilization, tow, or both, and any related fees. Detailed 10 information relative to obtaining such a hearing is provided on the 11 reverse side of the immobilization receipt. 12 CITY OF LITTLE ROCK 13 DEPARTMENT OF PUBLIC WORKS 14 (10) The city manager, or the manager's designee, shall have the authority to 15 implement the parking enforcement provisions of this section. 16 (11) Nothing in this section shall be construed to deprive any y person of the 17 constitutional right to a hearing or trial as to the violations charged. 18 19 Sec. 32 -323. Penalties. 20 The penalty for violation of overtime parking in unmetered restricted parking 21 areas in 32- 302 -32 -322, not specified within a particular section shall be: 22 (1) Thirty dollars ($30.00) if paid within thirty (30) days of the issuance of 23 the ticket: 24 (2) Forty -five dollars ($45.00) if paid after thirty (30) days of the issuance 25 of the ticket, or after conviction in district court for violation of city parking 26 ordinances. 27 A combination ticket and envelope shall be provided at the issuance of a 28 violation citation for the convenience of motorists. The penalty shall be paid by 29 placing such sum in the penalty box attached to the parking meters, or by paying the 30 fine to the city. 31 32 Secs. 32- 324 - -32 -340 Reserved. 33 34 Section 2. LOADING ZONES 2 Sec. 32 -341. Designation of curb loading places. 3 The City Manager or the manager's designee may determine the location of 4 passenger and freight curb loading zones and shall place and maintain appropriate signs 5 indicating the same. 6 7 Sec. 32 -342. Permits for curb loading zones. 8 (a) The City Manager or manager's designee shall not designate or sign any 9 curb loading zone upon special request of any person unless such person makes 10 application for a permit for such zone and for one (1) sign to indicate each zone. 11 (b) Any person desiring passenger loading or unloading zones may make 12 application in writing to the City Manager or manager's designee and pay to the city 13 four hundred dollars ($400.00) per year for one (1) metered space of twenty -two (22) 14 feet. 15 (c) In the event the request is for a loading zone outside of the parking meter 16 district then such person making the request shall pay to the city an annual fee of ten 17 dollars ($10.00) per foot or two hundred twenty dollars ($220.00) for a space of 18 twenty -two (22) feet per year for the purpose of covering the expense of the city in 19 painting, designating with appropriate signs, and otherwise maintaining the limited 20 parking or unloading zones. Such payment shall be made to the city on or before July 1 21 of each year. 22 (d) The person owning property adjacent to any zone designated by the City 23 Manager-or the manager's designee shall not be required to pay the maintenance fee as 24 required by this section, provided such zone is designated by the City Manager or the 25 manager's designee for the convenience of the general public. Such zones shall be 26 maintained and cared for at the expense of the city. 27 (e) It is unlawful for any person to paint the curb, sidewalk, or any part of the 28 street of the city in any manner whatsoever. It shall be unlawful for any person to 29 designate any part of any street of the city as being limited in any manner with respect 30 to parking thereon. 31 32 Sec. 32 -343. Standing in passenger curb loading zone. 33 No person shall stop, stand, or park a vehicle for any purpose or period of time 34 other than for the expeditious loading or unloading of passengers in any place marked ORDINANCE [PAGE 13 OF 22] To Amend LR Rev. Code Chapter 32, Article VI I as a passenger curb loading zone during those hours that businesses adjacent thereto 2 are open and conducting business. 3 4 Sec. 32 -344. Standing in freight curb loading zone. 5 No person shall stop, stand, or park a vehicle for any purpose or length of time 6 other than for the expeditious unloading and delivery or pickup and loading of 7 materials in any place marked as a freight curb loading zone during those hours that 8 businesses adjacent thereto are open and doing business. In no case shall the stop for 9 loading or unloading of materials exceed thirty (30) minutes. Commercial vehicles shall 10 be designated with signage as provided in section 32 -311. 11 12 Sec. 32 -345. Designation of public carrier stops. 13 The City Manager or the manager's designee may establish bus stops, bus 14 stands, taxicab stands and stands for other passenger common - carrier motor vehicles 15 on the public streets in places that will be of the greatest benefit and convenience to 16 the public. Bus stops, bus stands, taxicab stands, or other stands shall be designated by 17 appropriate signs as necessary. 18 19 Sec. 32 -346. Restricted use of bus and taxicab stands. 20 No person shalt stop, stand, or park a vehicle other than a bus in a bus stop or 21 other than a taxicab in a taxicab stand when such stop or stand has been officially 22 designated and appropriately signed, except that the driver of a passenger vehicle may 23 temporarily stop therein for the purpose of and while actually engaged in loading or 24 unloading passengers when such stopping does not interfere with any bus or taxicab 25 waiting to enter or about to enter such zone. 26 27 Sec. 32 -347. Hotel loading zones. 28 The City Manager or the manager's designee shalt establish and mark hotel 29 zones to be used solely for the loading and unloading of passengers and baggage. 30 Standing or parking in such hotel zones shall be limited to fifteen (15) minutes. No 31 person shall park a vehicle in a hotel zone except for the purpose of taking and 32 discharging passengers and baggage destined for the hotel. 33 ORDINANCE [PAGE 14 OF 22] To Amend LR Rev. Penalties. 2 The penalty for violation of overtime parking in unmetered restricted parking 3 areas in sections 32- 341 -347 not specified within a particular section shall be: 4 (1) Thirty dollars ($30.00) if paid within thirty (30) days of the issuance of 5 the ticket; 6 (2) Forty -five dollars ($45.00) if paid after thirty (30) days of the issuance 7 of the ticket, or after conviction in district court for violation of city parking 8 ordinances. 9 A combination ticket and envelope shall be provided at the issuance of a 10 violation citation for the convenience of motorists. The penalty shall be paid by 11 placing such sum in the penalty box attached to the parking meters, or by paying the 12 fine to the city. 13 14 Secs. 32- 349 -32 -370 Reserved. 15 Section 3. Little Rock, Ark. Rev. Code 5 32- 371 -32 -379 (1988) is hereby amended to read as 16 follows: 17 DIVISION 3. RESTRICTIONS FOR SPECIFIC PLACES 18 Sec. 32 -371. Scope. 19 The provisions of this division prohibiting the standing or parking of a vehicle 20 shall apply at all times or at those times herein specified or as indicated on official 21 signs, except when it is necessary to stop a vehicle to avoid conflict with other traffic 22 or in compliance with the directions of a police officer or official traffic - control device. 23 The provisions of this division imposing a time limit on parking shall not relieve any 24 person from the duty to observe other and more restrictive provisions prohibiting or 25 limiting the stopping, standing, or parking of vehicles in specified places or at specified 26 times. Except where provisions of this Code or signs erected provide otherwise, the 27 limitations on the standing or parking of a vehicle in this division shall not be 28 applicable between the hours of 6:00 p.m. and 8:00 a.m. and on Sunday and public 29 holidays. 30 31 Sec. 32 -372. Stopping, standing or parking prohibited during certain hours on certain 8 streets. 9 When signs are erected on any street or part of street in each block giving 10 notice thereof, no person shall stop, stand, or park a vehicle on any such street or part 11 of street in each block so designated between the hours specified by the signs, except 12 on Sundays and public holidays. 13 14 Sec. 32 -375. Parking time limited on certain streets. 15 (a) When signs are erected on any street or part of street in each block giving 16 notice thereof, no persons shalt park a vehicle on any such street or part of street in 17 each block so designated for longer than one (1) hour at any time between the hours of 18 8:00 a.m. and 6:00 p.m. of any day except Sundays and public holidays. 19 (b) Whenever by any provision of this chapter a parking time limit is imposed 20 or parking is prohibited on any street or part of street, it shall be the duty of the 21 traffic engineer to erect appropriate signs on such street or part of street giving notice 22 thereof. No such regulations shall be effective unless said signs are erected and in 23 place on the sides of the street or part of street where parking time is limited or 24 prohibited at the time of any alleged offense. 25 26 Sec. 32 -376. Parking in public parks. 27 No persons shall park a vehicle in any street, roadway, driveway or parking 28 area that is marked for parking, in any public park at any time or in any manner, 29 except as designated by lines or markings upon the pavement or ground. No person 30 shalt park any vehicle in front of or across any driveway or entranceway or within five 31 (5) feet of any driveway or entranceway to any picnic area or filter building located in 32 any public park. Nor shall any person park a vehicle at any place within a public park 33 whereby, by signs duly erected, parking is prohibited. 34 ORDINANCE PAGE 16 OF 22] To Amend LR Rev. Parking of common carriers at night. 2 No person, firm or corporation shall park a truck, tractor, bus, trailer or 3 semitrailer with a manufacturer's -rated capacity in excess of one (1) ton or greater on 4 any public residential street except when such vehicle is actually engaged in the 5 process of providing a direct public service. No person, firm or corporation shall use 6 any public street for the purpose of repairing any such truck, tractor, bus, trailer or 7 semitrailer or the chassis thereof except when such repairs are necessitated by an 8 emergency. 9 10 Sec. 32 -378. Restrictions during certain hours as designated by traffic engineer. 11 The traffic engineer is hereby authorized to determine the location of two -hour 12 parking zones and to place and maintain appropriate signs indicating the same and 13 stating the hours during which said limitations are applicable, provided that the 14 installation of such zones shall be subject to the following conditions: 15 (1) All so- called "two hour" zones heretofore designated and marked are 16 designated as two -hour parking zones. 17 (2) No person shall park any vehicle in any two -hour parking zone located 18 in the city for longer than two (2) hours at any time between the hours 19 so designated and if the hours are not designated then not longer than 20 two (2) hours at any time except on Sundays and holidays. All such two - 21 hour parking zones shall be designated by signs. 22 23 Sec. 32 -379. Penalties. 24 The penalty for violation of overtime parking in unmetered restricted parking 25 areas in sections 32- 371 -379 not specified within a particular section shall be: 26 (1) Thirty dollars ($30.00) if paid within thirty (30) days of the issuance of 27 the ticket: 28 (2) Forty -five dollars ($45.00) if paid after thirty (30) days of the issuance 29 of the ticket, or after conviction in district court for violation of city parking 30 ordinances. 31 A combination ticket and envelope shall be provided at the issuance of a 32 violation citation for the convenience of motorists. METERED PARKING' 5 Sec. 32 -401. Installation of parking meters. 6 The City Manager or the manager's designee shall install parking meters in 7 parking meter zones upon the curb immediately adjacent to each parking space. 8 9 Sec. 32 -402. Parking meter spaces. 10 The City Manager or the manager's designee shall designate the parking space 11 adjacent to each parking meter for which the meter is to be used by appropriate 12 markings upon the curb or the pavement of the street. Parking meter spaces so 13 designated shall be of appropriate length and width so as to be accessible from the 14 traffic lanes of such street. No person shall park a vehicle in any such designated 15 parking meter space during the restricted and regulated time applicable to the parking 16 meter zone in which such meter is located so that any part of such vehicle occupies 17 more than one (1) space or protrudes beyond the marking designating such spaces, 18 except that vehicle which is of a size too large to be parked within a single designated 19 parking meter zone shall be permitted to occupy two (2) adjoining parking meter 20 spaces when coins shall have been deposited in the parking meter for such space. 21 22 Sec. 32 -403. Deposit of coins and time limits. 23 (a) No person shall park a vehicle in any parking space upon a street alongside 24 of and next to which a parking meter has been installed during the restricted and 25 regulated time applicable to the parking meter zone in which such meter is located 26 unless a coin or coins of the appropriate denomination as provided in this division shall 27 have been deposited therein, or shall have been previously deposited therein for an 28 unexpired interval of time, and the meter has been placed in operation. 29 (b) No person shall permit a vehicle under his control to be parked in any 30 parking meter space during the restricted and regulated time applicable to the parking 31 meter zone in which such meter is located while the parking meter for such space 32 indicates by signal that the lawful parking time in such space is expired. This 33 subsection does not apply to the act of parking or the necessary time which is required 34 to deposit immediately thereafter a coin in the meter. ORDINANCE [PAGE 18 OF 22] To Amend LR Rev. Code Chapter 32, Article VI I (c) The penalty for violation of this provision shall be fifteen dollars ($15.00) 2 for each consecutive period of time the motor vehicle is parked in the space without 3 being moved if the ticket is paid within thirty (30) days of the issuance of a ticket. if 4 the fine is not paid until after thirty (30) days of the issuance of the ticket, then the 5 fine shall be fifty dollars ($50.00). A combination ticket and envelope shall be provided 6 at the issuance of a violation citation for the convenience of motorists. The penalty 7 shall be paid by placing such sum in the penalty box attached to the parking meters or 8 by paying the fine to the city. 9 (d) The provisions of this section shall not relieve any y person from the duty to observe other provisions of this chapter. I1 12 Sec. 32 -404. Use of slugs prohibited; tampering. 13 (a) No person shalt deposit or attempt to deposit in any y parking meter any slug, button, or any other device or substance as substitutes for coins of United States 15 currency. 16 (b) No person shall deface, injure, tamper with, open or willfully break, 17 destroy, or impair the usefulness of any parking meter. 18 19 Sec. 32 -405. Twelve - minute zones. 20 The City Manager or the manager's designee may determine the location of 21 twelve - minute parking meter zones upon the streets within the jurisdiction of this city 22 and place and maintain appropriate signs and parking meters indicating the same and 23 stating the hours during which the limitations are applicable. The installation of such 24 zones shall be subject to the following conditions: 25 (1) All "twelve- minute" zones heretofore designated and marked are 26 designated as twelve - minute parking zones. 27 (2) No person shalt park any vehicle in twelve - minute parking meter zones for 28 longer than twelve (12) minutes at any time between the hours of 8:00 a.m. and 6:00 29 on Monday through Saturday except on days and holidays and only upon the deposit of 30 a one -cent coin of the United States for each six (6) minutes in the parking meter 31 located alongside such zone. 32 33 Sec. 32 -406. Thirty- minute zones. 34 The City Manager or the manager's designee may determine the location of 35 thirty- minute parking meter zones upon the streets within the jurisdiction of this city ORDINANCE [PAGE 19 OF 22] To Amend LR Rev. The installation of such 3 zones shall be subject to the following conditions: 4 (1) All thirty- minute zones heretofore designated and marked are designated 5 as thirty- minute parking zones. 6 (2) No person shall park any vehicle in any thirty- minute parking meter zone 7 for more than thirty (30) minutes at any time between the hours of 8:00 a.m. and 6:00 8 p.m. on Monday through Saturday, except on Sundays and holidays, and only upon the 9 minimum deposit of twenty -five cents ($0.25) in the parking meter located along such 10 zone. 11 12 Sec. 32 -407. One -hour zones. 13 The City Manager or the manager's designee may determine the location of 14 one -hour parking meter zones upon streets within the jurisdiction of this city and place 15 and maintain appropriate signs and parking meters indicating the same and stating the 16 hours during which the limitations are applicable. The installation of such zones shall 17 be subject to the following conditions: 18 (1) All so- called one -hour zones heretofore designated and marked are 19 designated as one -hour parking meter zones. 20 (2) No person shall park any vehicle in any one -hour parking meter zone for 21 more than one (1) hour at any time between the hours of 8:00 a.m. and 6:00 p.m. on 22 Monday through Saturday, except on Sundays and holidays, and only upon the deposit 23 of a minimum of twenty -five cents ($0.25) in the parking meter located alongside the 24 zone. 25 26 Sec. 32 -408. Two -hour zones. 27 The City Manager or the manager's designee may determine the location of 28 two -hour parking meter zones upon streets within the jurisdiction of the city and place 29 and maintain appropriate signs and parking meters indicating the same and stating the 30 hours during which the limitations are applicable. The installation of such zones shall 31 be subject to the following conditions: 32 (1) All two -hour zones heretofore designated and marked are designated as 33 two -hour parking meter zones. 34 (2) No person shall park any vehicle in any two -hour parking meter zones for 35 more than two (2) hours at any time between the hours of 8:00 a.m. and 6:00 p.m. ORDINANCE [PAGE 20 OF 22] To Amend LR Rev. Banks shall pay the city for metered zones during 8 the time they are covered a fee of one hundred fifty ollars 150.00 Y ($ )per meter per 9 year. 10 1 1 Sec. 32 -410. Metered parking at the Little Rock Municipal Airport. 12 (a) The City Manager or the manager's designee, upon request of the Little 13 Rock Municipal Airport Commission, may locate various designated- minute parking - 14 meter zones upon the streets within the jurisdiction of the municipal airport 15 commission and place and maintain appropriate signs and parking meters indicating the 16 same and stating the hours during which parking limitations are applicable, if any. The 17 minutes authorized for such parking meter zones and the location of fine collection 18 boxes shall be designated by the municipal airport commission. 19 (b) The penalty for violation of this provision shall be fifteen ($15.00) for each 20 consecutive period of time the motor vehicle is parked in the space without being 21 moved if the ticket is paid within thirty (30) days of the issuance of a ticket. If the fine 22 is not paid until after thirty (30) days of the issuance of the ticket, then the fine shall 23 be fifty dollars ($50.00). A combination ticket and envelope shall be provided at the 24 issuance of a violation citation for the convenience of motorists. The penalty shall be 25 paid by placing such sum in the penalty box attached to certain parking meters or by 26 paying the fine to the city. 27 28 Section 32 -411. Penalties. 29 The penalty for violation of overtime parking in all metered parking areas in 30 sections 32 -401 through 32 -410 not specified within a particular section shall be: 31 (a) Fifteen dollars ($15.00) if paid within thirty (30) days of the issuance of 32 the ticket; 33 (b) Fifty dollars ($50.00) if paid after thirty (30) days of the issuance of the 34 ticket, or after conviction in district court for violation of city parking ordinances. Severability. In the event any portion of this ordinance is declared or adjudged to be 9 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of 10 this ordinance, which shall remain in full force and effect as if the portion so declared or adjudged 11 invalid or unconstitutional was not originally a part of this ordinance. 12 Section 6. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with 13 any provision of this ordinance are hereby repealed to the extent of such conflict. 14 Section 7. Emergency. It has been found and determined that the parking ordinances have been 15 amended over the years and require immediate clarification as to the types of parking available within 16 the city limits in order to protect the public health, safety, and welfare of the City and the inhabitants 17 thereof.
