CODE 4 CHAPTER 9, ARTICLE III, §9 -97 (1988) ; TO ADD DESCENDANTS 5 OF LOT OWNERS AS ELIGIBLE FOR APPOINTMENT TO THE 6 OAKLAND- FRATERNAL CEMETERY BOARD; TO AMEND "CITY 7 MANAGER" TO "MAYOR" TO CONFORM TO CURRENT LAW; 8 AND FOR OTHER PURPOSES. 9 WHEREAS, the Board of Trustees of Oakland - Fraternal Cemetery has requested 10 that their ordinance be amended to add "the descendants of lot owners" as eligible for 11 appointment to their Board in Little Rock City Code § 9 -97; and 12 WHEREAS, the second sentence of Little Rock City Code §9 -97 contains 13 language referencing the "city manager" that should be changed to "mayor' to conform 14 to current law. 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 16 OF THE CITY OF LITTLE ROCK ARKANSAS: 17 Section 1. Little Rock, Ark., Rev. Code § 9 -97) (1988) is hereby amended to read 18 as follows: 19 The Oakland - Fraternal Cemetery Board shall consist of seven (7) members 20 who shall be lot owners or descendants of lot owners therein. Members of the board 21 shall be appointed by the mayor subject to approval of the board of directors. The 22 terms of the members shall be for three (3) years and until their successors are 23 appointed and qualified. Vacancies for any unexpired term shall be filled in the same 24 manner as herein provided for the original appointment of members. Appointees to fill 25 vacancies shall serve for the unexpired terms. 26 27 Ordinance Professional Services [PAGE 1 OF 21 I Section 2. Severability. In the event any portion of this ordinance is declared or 2 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not 3 affect the remaining portions of this ordinance, which shall remain in full force and 4 effect as if the portion so declared or adjudged invalid or unconstitutional was not 5 originally a part of this ordinance. 6 Section 3. Repealer.
