HomeMy WebLinkAbout19804ORDINANCE NO. 19,804 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED RAWLS SHORT - FORM PCD (Z- 8193 -A), LOCATED AT 801 SOUTH CHESTER STREET, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from UU to PCD: Part of Lot 1, Block 248, Original City of Little Rock, Arkansas, Pulaski County, more particularly described as follows: Beginning at a set 1 /2" rod as the northeast corner of said Lot 1; thence S82'5 1'44"W, along the proposed south right of way line of Eight Street, for 84.01 feet to a set 1 /2" rod; thence N89 °26'54 "W, continuing along said proposed right of way for 25.0 feet to a set 1/2" rod; thence S59 °27' 14 "W, continuing along said proposed right of way line, for 19.41 feet to a set 1 /2" rod on the easterly right of way line of Chester Street; thence N04 °45'34 "E, along said easterly right of way line, for 19.22 feet to a found AHTD right of way marker on the north line of said Block 248; thence S80 °48'50 "E, along said right of way line for 125.09 feet to the point of beginning containing 454 square feet or 0.01 acres more or less. SECTION 2. That the approval Rawls Short-form PCD (Z- 8193 -A), located at 801 South Chester Street is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Rawls Short-form PCD (Z- 8193 -A), located at 801 South Chester Street is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
