ORDINANCE NO. 19,801 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED WOODLANDS EDGE CONCEPTUAL LONG -FORM PCD (Z- 5096 -B), LOCATED ON THE SOUTHEAST CORNER OF KANIS AND KIRBY ROADS LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from C -1, 0-3 and R -2 to PCD: Part of the W 1/z of the NW 1/4 NW 1/4, including all of Tracts 9, 10, 14 and part of Tract 15, Asbury Acres Subdivision, all in Section 8, T -1 -N, R -13- W, Little Rock, Pulaski County, Arkansas more particularly described as follows: Commencing at the southwest corner of said NW 1/4 NW 1/4, Section 8, being also the Southwest corner of said Tract 15 Asbury Acres; thence NO2 017'03 "E along the west line of said NW 1/4 NW 1/4, 304.68 feet to the point of beginning; thence NO2 °1.7'03 "E along the said west line, 1022.59 feet to the northwest corner of said NW 1/4 NW 1/4 being also the northwest corner of said Tract 9, Asbury Acres; thence S79 °02' 10 "E along the north line of said Tract 9, 133.0 feet; thence S87 002'46 "E along the north line of said Tracts 9 and 10, 496.58 feet to the northeast corner of said Tract 10; thence SOl °49'36 "W along the east line of said. Tracts 10, 14 and 15, 996.74 feet; thence N87 042'57 "W, 635.98 feet to the point of beginning containing 14.54 acres more or less. SECTION 2. That the approval of Woodlands Edge Conceptual Long -form PCD (Z- 5096 -B), located on the Southeast corner of Kanis and Kirby Roads is subject to compliance with the following additional conditions: • That the preliminary site development plan /plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Woodlands Edge Conceptual Long -form PCD (Z- 5096 -B), located on the Southeast corner of Kanis and Kirby Roads is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
