HomeMy WebLinkAbout19794ORDINANCE NO. 19,794 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED RESIDENTIAL DISTRICT TITLED KATILLUS COVE SHORT - FORM PD -R (Z- 8233), LOCATED ON THE WEST SIDE OF KATILLUS ROAD APPROXIMATELY 150 -FEET SOUTH OF CANTRELL ROAD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R -2 to PD -R: Part of the NE 1/4 NW 1/4 NW 1/4 of Section 24, T -2 -N, R -14 -W, Pulaski County, Arkansas more particularly described as follows: Beginning at a found 1/2 inch rebar, accepted as the Southwest corner of said NE 1/4 NW 1/4 NW 1/4, Section 24; thence NO2 °08'50 "E 329.31 feet to a found 1/2 inch rebar; thence S89 °01'43 "E, 343.30 feet to a found %2 inch rebar; thence S89 005'04 "E, 299.95 feet to a found 1/2 inch rebar on the west right of way line of South Katillus Road; thence S00 °06'43 "W along said west right of way line, 330.43 feet to a found 3/4 inch rebar; thence N88 °57' 16 "W, 654.97 feet to the point of beginning containing 214,034 square feet or 4.9135 acres more or less. SECTION 2. That the approval of Katillus Cove Short-form PD -R (Z- 8233), located on the West side of Katillus Road approximately 150 -feet South of Cantrell Road is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • No construction shall begin before 7:00 am. • All debris from the timber harvest must be moved to the southwestern area of the site prior to any burning activity. • A screening fence must be installed along the northern perimeter of Lots 20 - 24 and along the southern perimeter of Lots 1— 8 prior to construction of the proposed streets. SECTION 3. That the preliminary site development plan /plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Katillus Cove Short-form PD -R (Z- 8233), located on the West side of Katillus Road approximately 150 -feet South of Cantrell Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
