3 AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF ORDINANCES OF
4 THE CITY OF LITTLE ROCK, ARKANSAS, PROVIDING FOR A DEFERRAL OF
5 MASTER STREET PLAN CONSTRUCTION REQUIREMENTS FOR BROWNING
6 ROAD; AND FOR OTHER PURPOSES.

8 BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
9 Section 1. Chapter 30 of the Code of Ordinances is amended to provide for a deferral of certain
10 requirements within the Master Street Plan until the adjacent property along Browning Road is
11 developed. The property is located on the East side of Geyer Springs Road and North of Browning Rd.

13 Subsection a. Chapter 30 Article VI requiring developers to construct roadway
14 improvements to the requirements of the Master Street Plan will be deferred for a period of
15 five (5) years, until the lot that fronts Browning Road redevelops, or until adjacent
16 development along Browning Road occurs, whichever occurs first. The specific deferral is for
17 improving Browning Road to commercial street standards including widening to 18 ft from
18 centerline, curb, gutter, drainage improvements, and street lights. Sidewalk and access to the
19 site are currently being constructed.

21 Subsection b. On Browning Rd., 30 foot right of way from centerline for installation of the
22 improvements will be dedicated with the final plat.
23 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
24 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
25 declaration or adjudication shall not affect the remaining portions of the resolution which shall remain

in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
originally a part of the resolution.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
Section 5. This resolution wilt be in full force and effect from and after the date of its adoption.
