HomeMy WebLinkAbout19775ORDINANCE NO. 191775 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED SAGE MEADOWS LONG -FORM PCD (Z- 3173 -G), LOCATED ON THE WEST SIDE OF JOHN BARROW ROAD, SOUTH OF TANYA DRIVE, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R -2 and MF -12 to PCD: Part of the SW 1/4 of the SW 1/4, Section 11, Township 1 North, Range 13 West, of the Fifth Principal Meridian, Pulaski County, Arkansas, being more particularly described as follows: Beginning at the northwest corner of the SW '/4 of the SW 1/4 of Section 1 1, T -1 -N, R -13 -W; thence S88 020'43 "W 727.28 feet along the north line of said SW 1/4 of the SW 1/4 to a found 1/2" rebar; thence SO1 °45'37 "W 378.95 feet to a found 1 /z" rebar; thence S88 °14' 17 "E 547.09 feet to a found 1 /2" rebar on the west right of way line of John Barrow Road; thence along the said west right of way line the following courses and distances: SO1 °56'41 "W 292.06 feet; SO4 028'32 "W 100.11 feet; SO1 °49'25 "W150.0 feet; S02 044'55 "W 50.16 feet; thence SO 1056'40"W 29.91 feet to a point on the south line of said SW 1/4 of the SW 1 /4; thence departing from said west right of way line and along the said south line N88 °03'22 "W 1236.76 feet to the southwest corner of said SW 1/4 of the SW 1/4; thence NOI °49'59 "E 1321.72 feet along the west line of said SW 1/4 of the SW 1/4 to the point of beginning containing 33.932 acres more or less. SECTION 2. That the approval Sage Meadows Long -form PCD (Z- 3173 -G), located on the West side of John Barrow Road, South of Tanya Drive is subject to compliance with the following additional conditions: • That the preliminary site development plan /plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • The approved uses for the Commercial portion of the development shall be limited to the allowed uses per the C -1, Neighborhood Commercial District excluding a Cigar, tobacco and candy store. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Sage Meadows Long -form PCD (Z- 3173 -G), located on the West side of John Barrow Road, South of Tanya Drive is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
