HomeMy WebLinkAbout19759I ORDINANCE NO. 19,759 2 3 AN ORDINANCE TO ABANDON A PORTION OF COBB AND ZION STREETS AND 4 AN ALLEY LOCATED WITHIN BLOCK 81 OF THE JOHN BARROW ADDITION 5 AS PUBLIC RIGHTS OF WAY; AND FOR OTHER PURPOSES. 6 7 WHEREAS, a request was made to vacate and abandon a portion of Cobb and Zion Streets 8 adjacent to Block 81 of the John Barrow Addition, said portion being the entire length of Cobb Street 9 and the first 139.0 feet of Zion Street extending from West 28th Street in said Block 81, and the entire 10 length of the alley located within Block 81, all being within the John Barrow Addition, pursuant to the 11 City's general police power authority under Ark. Code Ann. S 14 -54 -104; and 12 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not 13 have an adverse impact on the adjacent property owners nor the local traffic, and therefore, the right - 14 of -way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise 15 noted below; 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE 17 ROCK, ARKANSAS: 18 Section 1. The Board of Directors hereby releases, vacates, and abandons a portion of Cobb 19 and Zion Streets adjacent to Block 81 of the John Barrow Addition, said portion being the entire length 20 of Cobb Street and the first 139.0 feet of Zion Street extending from West 28th Street in said Block 81, 21 and the entire length of the alley located within Block 81, all being within the John Barrow Addition of 22 the City of Little Rock. 23 Section 2. The City specifically reserves the public utility and drainage easements within the 24 former right -of -way. 25 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real 26 estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. 27 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, 28 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 29 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain 30 in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was 31 not originally a part of the ordinance. 32 Section 5. Repealer.
