HomeMy WebLinkAbout19756ORDINANCE NO. 19,756 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED RESIDENTIAL DISTRICT TITLED TRACT C CAPITOL LAKES ESTATES LONG -FORM PD -R (Z- 6120 -N), LOCATED ON THE SOUTHEAST CORNER OF CAPITOL HILLS BOULEVARD AND RUSHMORE AVENUE, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R -2, Single - family to PD -R: Part of the W 1/2 of Section 7, T -2 -N, R -13 -W, Pulaski County, Arkansas more particularly described as follows: Commencing at the northeast corner of the SE 1/4 NW 1 /4, said Section 7; thence SO1 °45'49 "W along the east line thereof, 512.14 feet to the point of beginning; thence continue SO1 045'49 "W, 992.92 feet; thence N50 °18'35 "W, 256.19 feet; thence N55 034'36 "W, 208.72 feet; thence N82 021'51 "W, 142.07 feet to a point on the east right of way line of Rushmore Avenue; thence northerly along said east right of way line being the arc of a 1349.78 foot radius curve to the left, a chord bearing and distance of N00 °07'43 "E, 678.99 feet; thence N8003 1'49"E, 244.97 feet; thence S84 045' 15 "E, 298.78 feet to the point of beginning containing 9.45 acres more or less. SECTION 2. That the approval of Tract C Capitol Lakes Estates Long -form PD- R (Z- 6120 -N), located on the Southeast corner of Capitol Hills Boulevard and Rushmore Avenue is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Tract C Capitol Lakes Estates Long -form PD -R (Z- 6120 -N), located on the Southeast corner of Capitol Hills Boulevard and Rushmore Avenue is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
