ORDINANCE NO. 19,748 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED INDUSTRIAL DISTRICT TITLED ECCO DEVELOPMENT CORPORATION REVISED LONG -FORM PD -I (Z- 4116 -B), LOCATED AT 8300 KELLETT ROAD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from PD -I to Revised PD -I: Parts of Sections 8 and 9, T -1 -N, R -11 -W, Pulaski County, Arkansas more particularly described as follows: Beginning at a point of the Section line between said Sections 8 and 9, which is 2532.4 feet north of the corner between Sections 8, 9, 16 and 17, T -1 -N, R -11 -W; thence N88 °50'W, 433.2 feet; thence N37 °OOE, 967.8 feet; thence S69031'E, 708.3 feet; thence S69 °37'E, 300.4 feet; thence S14 °51'W, 134.5 feet; thence S88050'E, 60 feet, more or less, to the centerline of Fourche Creek; thence Southwesterly along the centerline of Fourche Creek, 320.1 feet, more or less; thence N88 °50'W, 1025 feet, more or less to the point of beginning. Less and Except the following lands which were conveyed to the City of Little Rock by a Warranty Deed filed for record February 1, 1988 as Instrument Number 88- 04415, and described as: A tract of land situated in the NW 1/4 NW 1/4, Fractional Section 9, T -1 -N, R -11 -W, little Rock, Pulaski County, Arkansas, being more particularly described as follows: Commencing at a 1 1/2 inch pipe being 63.32 feet East of the Southwest corner of Lot 6, Cherry Acres Addition; thence N1 °56'33 "E, 939.7 feet to a 1 1/2 inch pipe; thence S88 °41'32 "E , 647.82 feet to a point of beginning; thence continuing S88 °41'32 "E approximately 180 feet to the centerline of Fourche Creek; thence northerly along the centerline of said Creek approximately 670 feet; thence S 14 °03' 56 "W, approximately 470 feet; thence S39 °07'36 "W, 171.41 feet to the point of beginning. SECTION 2. That the approval of Ecco Development Corporation Revised Long -form PD -I (Z- 4116 -B), located at 8300 Kellett Road is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Ecco Development Corporation Revised Long -form PD -I (Z- 4116 -B), located at 8300 Kellett Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
