ORDINANCE NO. 12,454
ORDINANCE OF THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS, VACATING AND
CLOSING PORTIONS OF MELLON STREET, KENTUCKY
AVENUE, AND ALLEYS IN BLOCK 3 AND BLOCK 6,
ABRAM'S SUBDIVISION OF BLOCKS 3, 4, AND 6 OF
PLUNKETT'S SUBDIVISION OF FOREST PARK ADDITION
TO THE CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas, on the 18th
day of January, 1971, asking the Board of Directors to vacate
and abandon portions of Mellon Street, Kentucky Avenue,and
alleys in Block 3 and Block 6, Abram's Subdivision of Block 3,
4 and 6 of Plunkett's Subdivision of Forest Park Addition to
the City of Little Rock, as designated on the plat of said
Additions now appearing of record in Plat Book 1, Page 32, and
Plat Book 3, Page 89, in the office of the Recorder of Pulaski
County, Arkansas, subject, however, to any public easements in
said streets and alleys; and
WHEREAS, after due notices as required by law, the Board
of Directors has,,at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that said streets and alleys above described have
heretofore been dedicated to the public use as a streets and
alleys, as herein described; have not been actually used by the
public generally for a period of at least five (5) years sub-
sequent to the filing of the plat; that all of the owners of the
property abutting upon the alley to be vacated have filed with
the Board of Directors their written consent to such abandonment;
and that public interest and welfare will not be adversely affected
by the abandonment of such streets and alleys;
NOW, THEREFORE, BE IT.ORDAINED BY THE BOARD OF DIRECTORS

MELLON STREET from Cantrell Road North to Iowa Avenue;
KENTUCKY AVENUE lying between Block 3 and Block 6 of
Plunkett's Subdivision of Forest Park Addition, and
extending Eastward for a distance of 145 feet from
the East line of Mellon Street;
A 10 foot alley running East and West in Block 3, and
a 10 foot alley running East and West in Block 6, of
Abram's Subdivision of Blocks 3, 4, and 6 of Plunkett's
Subdivision of Forest Park Addition, except that part
of the alley in said Block 6 which lies within the right
of way of Cantrell Road (Arkansas State Highway No. 10).
subject, however, to any public utility easements located in
said streets and alleys.
SECTION 2. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the office of the Recorder of
Pulaski County and recorded in the Deed Records of the County.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage.
